You should probably check Los Angeles county criminal records. It appears he used an alias: "Joe Kirk." This event occurred in Sioux City in Woodbury county, Iowa.
Arrest Man on Fugitive Charge Here
A 57-year-old man who authorities said recently entered business for himself here will appear for preliminary hearing at 2 p. m. May 5 on a fugitive from justice charge. He is Joe Kirk, also known as Joe K. Spitzengel, 419 W Third street. He furnished a $1,000 bond Saturday on the charge, filed on a warrant, issued from Los Angeles. The defendant was taken into custody Friday by Detective Marvin S. Lambert after Los Angeles authorities informed Sioux City police that a warrant had been issued for burglary and five counts of forgery allegedly committed on the west coast in December of 1955.
Habeas Corpus Filed
The information on the fugitive charge was issued after a habeas corpus proceeding had commenced earlier Saturday. At that time Municipal Judge Berry J. Sisk gave officials here until 11:30 a. m. Saturday to determine when the warrant was issued and when it would arrive. Lambert placed a call to Los Angeles and was informed the warrant had been airmailed Friday. Particulars concerning the burglary and forgery counts were not learned.
Extradition Refused
It was learned here that Kirk had been employed in Los Angeles several years, and more recently had been employed in Sioux City. The defendant told police he would refuse extradition to California. The next step would be a request by the California governor to take Kirk into custody. Alter the information had been filed, the court ordered the habeas corpus proceeding dismissed.
