Know all men by these present, that I, Israel Phillips Of Clayton County State of Iowa being of sound mind and memory and considering the uncertainty of this frail and transitory life do therefore make ordain publish ,and declare, this to be my last will and testament; That is to say First ,after all my lawful debts, are paid and discharged, the residue of my estate, real and personal give ,bequeath, and dispose of as follows, To wit; to my beloved wife, Sally C. Phillips all my property both real estate and personal to have and to hold to use and dispose of as she may see fit during her natural life and provided she may die with out making a will and there being any of the property left ,it shall be equally divided between my three youngest sons and their heirs. To wit; Samuel G. Phillips, Reuben H. Phillips, and Seymore H. Phillips. Likewise I make, constitute, and appoint, my wife Sally C. Phillips to be executor of this my last will and testament, hereby revoking all former wills by me made. In witness, where of. I have here unto subscribe my name and affixed my seal this 28th day of December A.D. 1870.
Israel Phillips (word I Can't read)The above written instrument was subscribed by the said Israel Phillips in our presence, and acknowledged by him to each of us ; and he, at the same time published and declared the above instrument to subscribed to be his last will and testament; and we, at the testators; request, and in his presence, have signed our name, as witnesses, here to ,and written opposite our names, our respective places of residences,(signed) Lucy A. Penfield-Wm A. Penfield Justice of the Peace--Volga City Clayton Co. Iowa.
