Last Will of August Uschalt, Died 1884

[TRANSCRIBER’S NOTES: 1) The tombstone for this man at Guttenberg clearly spells this surname as Uschalt, as seen at findagrave.com. The name is clearly spelled as Uschalk in the transcribed will, however. 2) The word “Nephew” is underscored with dots in the will as if to note the discrepancy between that word and the female name that follows it.]

In the name of God Amen: I August Uschalk of the Town of Guttenberg in the county of Clayton and State of Iowa of the age of Seventy years and being of sound mind, do make publish and declare this my last Will and Testament in manner following that is to say:

First – I give and bequeath to my wife Elizabeth Uschalk all of my Real and personal property of which she shall have all the use as long as she may live and the full use thereof during her natural life, and after her death all of my Real and personal property shall go to my Nephew Mary Ortmann now residing in Volga Township Clayton County Iowa, and lastly I hereby appoint my wife Elizabeth Uschalk sole Executrix of this my last Will. In witness whereof I have hereunto set my hand this 16th day of April in the year of Our Lord One Thousand Eight hundred and eighty four.

The above instrument consisting of one sheet was at the date thereof signed and declared by the said August Uschalk as and for his last Will and Testament in the presence of us who at his request and in his presence have subscribed our names as witnesses thereto

I James E. Corlett Clerk of the Circuit Court in and for said County, do hereby certify that on this day at the May Term, A. D. 1885, of said Court, the Will and Instrument in Writing hereunto annexed, and bearing date on the 16th day of April 1885 [sic], was duly approved before and allowed by said Court as and for the last Will and Testament of the Real and personal estate of August Uschalk late of said County deceased, and was by said Court ordered to be Recorded as such Will and Testament. In witness whereof, I have hereunto set my hand and affixed the seal of said Court, at my office, in Elkader, in said County this 15th day of May A. D. 1885
