COURT OPENS AT CLARINDA

JUDGE THORNELL HAS PLENTY OF
WORK BEFORE HIM

Clarinda, Iowa, April 1 – District Court opened yesterday for the March term with Judge Thornell on the bench, and a full trial docket for him to work out of the wat. Some important cases will be tried, among them being a suit against the Burlington for the killing of William Depew on the 30th of January last. The old gentlemen was walking upon the right-of-way about three miles north of Clarinda, and had started to cross along trestle when he discovered the Villisca accommodation train coming at a great speed and, realizing he could not reach the other end of the trestle ahead of the train, he started to retrace his steps, but was caught by the pilot before reaching the grade. Negligence on the part of the company is alleged to consist at running at an unreasonable speed, the lack of signals and the improper or insufficient brake appliances.
