LAST WILL AND TESTAMENT OF HENRY L. DONNER
I, Henry L. Donner, of the County of Mills and State of Iowa, do hereby make, publish and declare this my last will and testament, hereby revoking all former wills by me made, in manner and form following:
First: I direct that all of my just debts existing at the time of my death, and the expenses of my last sickness and burial be paid as soon after my decease as can conveniently be done.
Second: Subject to the foregoing provision, and the payment of Five Dollars to my son Wallace Donner hereinafter bequeathed to him, I give, will devise and bequeath to my beloved wife Sarah E. Donner all of the personal property of which I may die seized and possessed or to which I may be entitled, the same to be hers in her own right. I also give, will and bequeath to my said wife Sarah E. Donner, in lieu of her distributive share, a life estate in all the real estate I may own at the time of my decease, the same to be hers for the period of her natural life, she to enjoy the use and occupancy, and rents and profits thereof so long as she may live; but she shall not sell or mortgage the whole or any part thereof.
Third: I give and bequeath to my son Wallace Donner, Five Dollars, to be paid from the personal property of my estate. The reason I do not give my said son a larger bequest is because he has had a good deal of help from me heretofore given him.
Fourth: To my four daughters, Alta May Nellen, Dottie T. Donner, Lottie M. Robb and Sadie E. Donner I give, will and bequeath One Thousand Dollars each, i.e. One Thousand apiece, each of them is to have and receive the said sum of One Thousand Dollars to be paid as hereinafter provided.
Fifth: Subject to the life estate hereinbefore bequeathed to my said wife, I give, will, devise and bequeath to my son Roy G. Donner, the East half of the South East quarter of Section Seventeen, Township Seventy two, Range Forty one, and the undivided one half of the S ½ of the NE ¼ of the SE ¼ of Section 36, Township 72, Range 42, except 3 acres off the west and all in Mills County, Iowa. And I hereby obligate and direct my said son Roy G. Donner within one year from and after the death of both my said wife and myself, to pay to my said daughters, Alta May Nellen, Dottie T. Donner and Lottie M. Robb, each the sum of One Thousand Dollars above willed the them, and each of them, and I hereby make said sum of $3,000 a lien upon the real estate given my said son Roy G. Donner, until paid; and in the event of his failure or refusal to pay the same within the time specified, I direct my executor to sell enough of the real estate so given my said son Roy G. Donner to pay said legacies.
Sixth: Subject to the life estate hereinbefore bequeathed to my said wife, I give, will, devise and bequeath to my son Irven L. Donner the West half of the South West quarter of Section Sixteen, Township Seventy two, Range Forty one; and the undivided one half of the S ½ of the NE ¼ of the SE ¼ of Section 36, Township 72, Range 42, except 3 acres off the West end; all in Mills County Iowa; And I hereby obligate and direct my said son Irven L. Donner, within one year from and after the death of both my said wife and myself, to pay to my said daughter Sadie E. Donner, the sum above willed her, to wit: One Thousand Dollars, and I hereby make said sum a lien upon the real estate given my said son Irven L. Donner, until paid; and in the event of his failure or refusal to pay the same, I direct my executor to sell enough of the real estate so given my said son Irven L. Donner to pay said legacy.
I nominate and appoint J. C. Slothower, of Mills County, Iowa, executor of this my last will and testament and instruct him to carry out the same in all its terms and conditions. Dated and signed this 17th day of May 1909. Henry L. Donner
