LAST WILL AND TESTAMENT OF JOCKIM KAY
Know all men by these presents: That I Jockim Kay of Mills County, State of Iowa, being of full age and sound mind and disposing memory, do make, publish and declare this my last will and testament.
First---I desire that all my lawful debts, the expenses of my last sickness and burial that the administration of my estate be first paid and subject thereto.
Second---I give and bequeath to my beloved wife Margaretha Kay, instead of her dower and legal share of my estate, all of the income, rents and interest of all real estate, of all personal property, monies of which I shall die seized and possessed, to be enjoyed by her during her natural life, she paying taxes and repairs.
Third---.After my decease and the decease of my said wife Margaretha Kay, all my estate consisting of real estate and personal property monies and credits of which I shall die seized and possessed, or to which I shall be entitled at my death shall be equally divided share and share alike among my seven hereinafter named children their heirs at law except that my son Henry shall receive the sum of two thousand dollars less than each of the other children; he having received from me over ten years ago the sum of Thirteen hundred Dollars at the time he bought the property at Pony Creek, in Pottawattamie County, Iowa, known as the 5 mile house near Council Bluffs, Iowa, and on which sum he never paid any interest.
1. To my son Henry Kay one seventh of my estate except $2,000 less than each of his brothers and sisters or their heirs at law.
2. To my son William Kay one seventh of my estate.
3. To my son Theodore Kay one seventh part of my estate
4. To my daughter Anna, wife of W. A. Bichel, one seventh part of the estate.
5. To my son Adolph Kay one seventh part of my estate.
6. To my daughter Helena, wife of Louis Deitchler one seventh of the estate.
7. To my daughter Clara wife of Gustave Deitchler one seventh of my estate.
Fourth---I do hereby appoint my sons Theodore Kay and Adolph Kay of Mills County, Iowa, Executors of this my last Will and Testament and request that they shall not be required to furnish bonds for the faithful performance of their duties as such executors.
