Last Will and Testament of Samuel O. Burgess

I, Samuel O. Burgess of Mills County, Iowa, being of sound and disposing mind, and while in the full and complete possession of all my mental faculties, and for the purpose of adjusting, as well as arranging my business affairs as shall seem to me right and proper do make publish and declare, this to be my last will and testament, hereby revoking, cancelling and destroying all former wills by me made; that is to say after my death, and respectable burial I will bequeath and dispose of the rest and residue of all my property, both real and personal of every kind and character as follows, to wit:

First..I will and give to my beloved wife Mary E. Burgess all of my real and personal property of every kind and description to have and hold the same as her own and in her own right.

Second..It is my further desire, as well as my request, that my beloved wife shall at all times see to it that our adopted daughter, Margaret E. Burgess, if she shall survive me, and at a time when she shall reach majority, give to her such sum or sums as may she deem right and proper out of the estate which I have willed and given herein to my beloved wife, in order that our said girl may have at least some small start in life, so far as financial affairs are concerned.

Third..I further desire and ask my said beloved wife, should she survive our said adopted daughter, to so make such arrangements, with our said girl, that in no event can her father get hold of any property going to our said girl.

I ask that my beloved wife, Mary E. Burgess be appointed as my sole executrix of this my last will without bond. Dated at Glenwood, Iowa, February 8th 1913. Signed..Samuel O. Burgess

The foregoing will was by the testator Samuel O. Burgess signed by him in our presence and we at his request and in his presence and in the presence of each other have signed our names thereto as witnesses for him, and have caused to be written opposite our names our respective places of residence.
