Will Of Joshua E. Shelby Deceased.
In the name of God, Amen.
I, Joshua E. Shelby of the township of Rawles, Mills County, Iowa, of the age of 74 years, and being of sound mind, and memory, do make, publish and declare this my Last Will and Testament, in manner following, that is to say;
First I order and direct that my executrix shall pay all my lawful debts and funeral expenses.
Second, I give and bequeath to my beloved wife Rebecca Shelby, all monies, goods and chattel property of all kinds and description, of which I may die seized.
Third, I also give and devise to my wife Rebecca Shelby, a life estate, of my interest in our homestead and farm consisting of 75 acres more or less, situated in Rawles & Lyons Twp. Mills County, Iowa, and upon her decease I give and devise said interest in said real estate to my heirs as now mentioned, James W. Shelby, Martha Ann Powers, Deborah Coleman, Sarah Hubbell, Rebecca Bailey, Julia Reels, share and share alike.
My reason for excluding my son Joshua E. Shelby and Theophilus Hall Shelby from any bequest or share in my property, is that they have already received from me, more than their distributive or legal share of my estate. I also desire that my grandchildren shall have no share or interest or inheritance in and by virtue of this will (in my estate) and upoin the death of their parents (my heirs) said interest shall revert to the other living heirs, share and share alike.
I hereby nominate and appoint my wife Rebecca Shelby as executrix without bond of this my Last Will and Testament.
In witness whereof I have hereunto set my hand & seal this 13th day of October 1900.
Joshua E Shelby (seal)
The above instrument, consisting of two (2) sheets, was at the date thereof, signed and declared by the said Joshua E. Shelby as and for his Last Will and Testament in presence of us, who at his request and in his presence and the presence of each other have subscribed our names as witnesses thereto, this Oct 13, 1900.
