I John Burton, of Emerson, in the County of Mills, and State of Iowa, being of sound and disposing mind and memory, do make, publish and declare this to be my last will and testament thereby revoking all former wills by me at any time heretofore made.
And as to my worldly estate and all the property, real, personal, or mixed of which I shall die seized and possessed, or to which I shall be entitled at the time of my decease I devise, bequeath, and dispose thereof in the manner following towit;
My will is, that all my just debts and funeral expenses shall, by my Executrix hereinafter named, be paid out of my estate, as soon after my decease as shall by her found convenient.
I give devise, and bequeath to my beloved wife, Emily, during her life, and so long as she shall remain a widow, the use, improvement, and income of my dwelling-house land and its appurtenances, situated in the town, county and state aforesaid and described as lots One hundred eighty four (184), One hundred eighty-nine (189) and One hundred ninety (190) in the original town of Emerson, Iowa, and after her decease or remarriage, I give and bequeath to my children, hereinafter named to be equally divided among them.
I give and bequeath to my wife all my household furniture, books, pictures, beds, bedding and all other articles contained in my house at the time of my decease, except money and security for money, evidences of debt and title and vouchers.
I give and bequeath to my wife one-third (1/3) of all the remainder of my property to have and to hold the same to her and her executors, administrators, and assigns forever.
All the rest and residue of my estate, real personal, and mixed, of which I shall die seized and possessed, or to which I shall be entitled at my deceased, I give devise and bequeath to be equally divided among my children Sarah E. Miller, Rose Sutton, Annie M Sutton, Jennie M. Lehr, Josephene Richmond, Grace A. Henry, Alice M. Lutes, John C. Burton, Blanch E. Burton and Nellie V. Burton.
And lastly I do nominate and appoint my beloved wife, Emily to be the Executrix, without bond, of this my last will and testament.
In witness whereof I the said John Burton, have to this my last will and testament consisting of one sheet of paper, subscribed my name and affixed my seal this 16th day of October, in the year of our Lord One thousand nine hundred and thirteen.(1913)
