I Samuel Boyer of Glenwood, Mills County, Iowa, being now in my sixty first year and being of sound and disposing mind, do make, publish and declare this my Last Will and Testament. Hereby revoking all former wills by me made.
First- I give and bequeath to my wife Lucinda Boyer all of my property, both real and personal. The personal property she is to have and hold forever. Of the real estate she is to have and hold for her own benefit, to enjoy the rents and profits during her natural life and at her death said real estate to be divided equally among my heirs. Knowing the location and surrounding conditions of my farm in Plattville Township, Mills COunty, Iowa, and as I shall herein after name my wife Lucinda Boyer my sole executor, I desire to give her authority, at such time and on such conditions as will be to the best interests of herself, my heirs and my estate to exchange said real estate for other real estate and this power shall include the right to sell said real estate as my executor, and the proceeds of such sale to be invested in other real estate by my said executor and when so invested the
title to said lands to be taken in the name of said executor as my executor and she my said wife to enjoy the rents, and profits of said real estate during her natural life. Provided however that my wife Lucinda Boyer shall pay or cause to be paid all charges against said real estate and the taxes from year to year.Second- The above gifts and grants to my said wife are upon the expressed condition that she pay or cause to be paid all of my just debts and funeral expenses out of my said esate.
Third- I further direct and will that no division of my said real estate be made until after the death of my said wife Lucinda Boyer.
Fourth- I request my said wife not to sign as security the note or notes or bonds of any persons whomsoever. This request is made because of my greater experience in life than my said wife has enjoyed.
I hereby appoint my wife Lucinda Boyer my sole executor of this my Last Will and Testament, without bond.
Dated at Glenwood, Mills County, Iowa, this 24th day of October 1904.
Not withstanding the above will seems to have been completed and ready for signature, on further reflection I hereby make and declare all of the conditions with reference to my property as heretofore expressed in this instrument to be on the condition that my said wife remain my widow. But should she consider it advisable to remarry, then and in that event, I direct that said real estate be divided according to the statues of this state giving to my said wife one third, thereof, and giving the other two thirds to be divided among my other heirs. Of the last clause of this will as well as all other clauses of this will I hereby appoint my said wife Lucinda Boyer the sole executor of this my Last Will and Testament, without bonds.
Dated Glenwood, Iowa, Mills County, This 24th day of October 1904.
