I Andrew Schappel, of Glenwood, Mills County, Iowa, being of sound and disposing mind, do make publish and declare this to be my last Will and Testament, hereby revoking all former wills by me made.
Item I. I direct that my just debts and funeral expenses be first paid out of my estate.
Item II. All the rest, residue and remainder of my estate, real, personal or mixed, of which I may die seized or possessed, or to which I may be entitled, I will, devise and bequeath as follows;
1. To my beloved wife, Mariett Schappel, I give devise and bequeath absolutely, the following described real estate situated in Mills County, Iowa, to-wit;- Lots one and two (1 and 2) in Block Eighty four (84) in Gordon's addition to the City of Glenwood, Iowa, according to duly recorded plat thereof, together with all my personal property of whatever kind and character of which I may die possessed.
I also give and devise to my beloved wife a one Third (1/3) interest in all the balance of my real property of which I may die seized subject however to the following conditions, in Event the one third (1/3) interest herein devised to my said wife, be not disposed of for her maintainance during her life-time, and shall die possessed of the same, then the said one third shall be equally divided among my four daughters, Minnie, Lena, Rhoda, Clara, it is my intention herein to vest a one third (1/3) life estate interest in my said wife and to giver her interest thereto the power to dispose of her life estate and also the fee to said one third (1/3) interest if it shall be necessary to do so to provide for her maintainance. She shall be entitled to use and occupy my homestead as a home during her life time, unless said homestead shall be sooner sold.
The provisions herein made for my wife Mariett Schappel shall be in Lieu of all her statutory rights in and to my estate.
2. To my daughter Lena Schappel, I give devise and bequeath three fifths of one third (3/5 of 1/3) of all the real property of which I may die seized, subject to devise to my wife, and to debts and claims against my estate.
3. To my daughter Clara Schappel I give, devise and bequeath two fifths of one third (2/5 of 1/3) of all the real property of which I may die seized to devise to my wife, and to debts and claims against my estate.
4. To my grandchildren Miriam Fair, I give and bequeath the sum of fifty dollars ($50.00). to be paid from the proceeds of the sale of the remaining one third of my real property, when said property shall be sold or disposed of.
5. The remainder of my real estate after deducting the 50.00 bequeathed to Miriam Fair, shall be divided equally between my four daughters, Minnie McCoy, Lena Schappel, Rhoda Fair and Clara Schappel.
6. It is my intention that noneof my debts or the claims against my estate shall be a charge on the property in block Eighty Four, herein conveyed to my wife, but that such debts and claims shall be a charge upon and be paid from the remainder of my estate.
7. I have purposely failed to make any provisons herein for my sons Frank Schappel and Charles Schappel for the reason that adequate advancements have been made to them.
Item III. I hereby appoint J.L. Bellatti and John Fair both of Glenwood, Iowa as executors of this my Last Will and Testament.
