I James E Barnes, of Deer Creek Township, Mills County, Iowa, being of sound mind and memory, do hereby publish and declare this my last will and testament.
I direct my executor hereinafter named to pay my funeral expenses and all my just debts as soon as can conveniently be done after my decease.
I give and bequeath to each of my four children Jennie E. Lang, John I. Barnes, James H. Barnes, and Robert E. Barnes one fourth of all the real and personal property of which I may be seized at the time of my death, after all my expenses and just debts have been paid as above stated. In the event that my said children cannot agree upon an equitable division of said real and personal property the same shall be sold and an equal division of the proceeds made. These bequests are made to my said chilren subject to the condition that each of them shall pay annually to my said wife Emma A. Barnes such sum as she shall name in lieu of the one third interest in my estate she might otherwise hold.
The provision of this my last will if accepted by my said wife, shall be in lieu of all dower and rights which my said wife shall have or claim in my estate.
This provision for the payment of annuity to my wife shall cease should she re-marry. I hereby appoint my wife Emma A. Barnes executor of this my last and request that she be not required to give bond.
In witness whereof I have hereunto subscribed my name and affixed my seal this 16th day of March 1909.

Signed, sealed, published and declared by the said testator James E. Barnes as and for his last will and testament in the presence of us, who, at his request and in his presence, and in the presence of each other, have hereunto subscribed our names as witnesses.
