LAST WILL AND TESTAMENT OF JAMES I. STOUT
I, James I. Stout, of the City of Glenwood, County of Mills and State of Iowa, do hereby make and declare this my last Will and Testament, in manner and form following:
First-I direct that all my just debts and funeral expenses be paid as soon after my decease as conviently be done.
Second-I give and bequeath to my beloved wife, Phoebe Stout, should she survive me, the life use and occupancy, rents and profits of my farm in Mills County, Iowa. To wit; W 1/2 of the SE 1/4, except 5 1/2 acres in the northwest corner: S 1/2 of the SW 1/4, except the 3 acres in the S.W. Corner; Nine acres more or less in the S.E Corner of the N 1/2 of the SW 1/4 all in Section 20, Township 73, Range 42, provided she remains unmarried; and at her death I give and bequeath said land to my nephew H. M. Stout. And in the event my said wife should remarry, I give and bequeath to her the undivided one half of said land in Mills County, Iowa, in fee simple, and the other undivided one half to my nephew H. M. Stout. I also give and bequeath to my wife, all my household and kitchen furniture of every kind and description, except my large leather rocker which I give and bequeath to my nephew H. M. Stout.
Third-I give and bequeath to my nephew H. M. Stout the undivided one half of section thirteen, Township ten, N, of Range 47, in Sedgwick County, State of Colorado.
Fourth-I give and bequeath to my neice Luella Mellick the east 50 feet of lots 7, 8 and 9, in Block 6, West Addition to town or city of Kearney, Buffalo County, State of Nebraska, with all improvements thereon.
Fifth-The bequest herein made to my said wife is in lieu of her distributive share.
Sixth-I give and bequeath to my sister Eliza Gray, my sister Jannie Miller, and my brother M.J. Stout O N E Dollar each and no more.
Seventh-I hereby revoke all former wills and testamentary dispositions by me at any time heretofore made.
Eighth-I hold two promissory notes signed by W. P. Marsh and wife aggregating $1700.00 these notes I give and bequeath to Bells Comb and Hepsey Wright, share and share alike.
Ninth-I nominate and appoint my wife, Phoebe Stout and my nephew H. M. Stout, joint executrix and executor of this my last will and statement and exonerate them from giving bond for the faithful performance of their duties.
In witness whereof I have hereunto subscribed my name in the city of Glenwood, this 25th day of October 1913 in the presence of witnesses called and requested by me to become attesting witnesses hereto.

We the undersigned, hereby certify that the foregoing instrument was signed by James I. Stout in our presence and by him declared to be his last will and testament, and that we at his request, in the presence and in the presence of each other hereunto subscribe our names and residences as attesting witnesses, this 25th day of October, 1913.
