WILL OF HENRY H. RIST OF MILLS COUNTY IOWA
I, the undersigned, Henry H. Rist, of Glenwood, Iowa being of sound and disposing mind and
memory do hereby make publish and declare this to be my last will and testament, in manner
and form following, that is to say.I direct that all my just debts and funeral expenses be paid out of my estate from the personal
property, as soon after my decease as shall be convenient, and I also direct that a suitable
family monument shall be purchased and caused to be erected by my executors same to be
paid from the personal property, and cost and design left to their discretion.I give, devise and bequeath to my wife, Martha E. Rist, the home farm on which we now reside
same being described as lot Thirteen of subdivision of section fourteen and lot thirty five of
subdivision of section Eleven, all in Township Seventy Two, Range Forty Three, Mills County
Iowa, containing 27.11 acres more or less; I also give and bequeath to my wife all of my
personal property, of every kind and nature, except the sum of One Thousand Dollars which I
hereinafter bequeath to my son Roy E. Rist, and subject to the provisions of paragraph
number one hereof, my wife to have the full control of all of the said real estate and personal
property so given her, during her life time, and to use as she may wish, but I direct that all
which remains thereof, both said real estate and personal property after her decease, I direct
that said remaining amount shall at her death descend in equal shares to my two children only,
viz; Cloid H. Rist and Maud E. Rist.I give to my son Cloid H. Rist the South Half of the Northeast quarter of section Thirty three,
Township Seventy Two, Range Forty Two in Mills County, Iowa being the South Half of my
Center Township 160 acre farm, the half on which the buildings on said farm are situated.I give to my daughter Maud E. Rist, the North half of the Northeast quarter of section Thirty
Three, Township Seventy Two, Range Forty Two, Mills County Iowa, the same being the
North Half of my said Farm in Center Township, and the part other than that containing the
buildings, my intention being to give said farm in full and absolute ownership to my said two
children Cloid H. Rist and Maud E. Rist as herein provided and at paragraph #3, hereof.I give and bequeath to my son Roy E. Rist the sum of One Thousand dollars from my personal
property, which is all that I give to my said son from my entire estate, and I direct that my son
Cloid H. Rist and my daughter Maud E. Rist, act as guardian or trustees of said $1,000, for my
son Roy and that they be so appointed to receive and hold the same without bond and are
authorized to expend the said amount for him as shall in their discretion seem best, and I ask
and request that they be so appointed by the court for said purpose, without giving bond.In the event that either my son Cloid H. Rist or my daughter Maud E. Rist shall at any time die,
without leaving child or children surviving them then I direct that the one who may survive of
said two children shall receive the entire share and property which the other would receive
under this will both by direct bequest, or which may come to them from the residue left by my
wife, their mother, as hereinbefore provided as to such residue.I hereby appoint my son Cloid H. Rist and my daughter Maude E. Rist as executor and
executrix of this my will, jointly and ask that they be appointed as such by the probate court
without bond.Witness my hand this 26th day of March, 1919. Signed Henry H. Rist
We the undersigned, do each hereby certify that we saw Henry H. Rist sign the foregoing
writing which he declared to be his last will and testament that we at his request in his
presence and in the presence of each other then and there attached our names hereto as
subscribing witness to said will.
