WILL OF PHILIP HAMBSCH
Know all men by these presents:
That I, Philip Hambsch, of Malvern, Iowa, being of sound mind and memory do make publish
and declare this to be my last will and testament as follows to wit:Item 1. It is my will and I hereby devise and bequeath to my beloved wife Elizabeth Hambsch
the use and rentals of all the property that I now own during her life, that is, she is to have the
control and income of all my real property in lieu of a dower interest and at her death or in the
event that she should die before my decease I then will and direct that my property including
real, personal and mixed be divided as follows:Item 2. It is my will and I hereby devise and bequeath to my son, Charles Hambsch, subject to
the provisions in Item 1 hereof, the South East Quarter of Sec. 29 in Township 27 North of
Range 50 West of the 6th P.M. in Box Butte County and State of Nebraska I have already and
heretofore given to my said son Charles Hambsch 80 acres of land in Mills County Iowa.Item 3. It is my will and I hereby devise and bequeath to my son Amos P. Hambsch, subject to
the provisions as contained in item 1 hereof, the North East Quarter of Section 29, in
Township 27 North of Range 50 West of the 6th P.M., in the County of Box Butte and State of
Nebraska. I having heretofore given to my said son Amos P. Hambsch 80 acres of land in Mills
County.Item 4. It is my will and I hereby devise and bequeath to my daughters Emma Hambsch and
Mary Johnson in equal portions, share and share alike, subject to the provisions contained in
Item 1 hereof, the west one half of the North East Quarter of Section 26 and the South West
Quarter of the South East Quarter of Section 23 all in Township 71, Range 41, Mills County
Iowa.Item 5. It is my will and I hereby devise and bequeath to my daughter, Emma Hambsch the
South West quarter of Section 12 in township 27 North of Range 52 West of the 6th P.M. in
Box Butte County, Nebraska, also Lots 289 and 290 in Strahans addition to the town of
Malvern, Iowa, being the homestead in which my wife and I now live. The household and
kitchen furniture therein shall be divided equally between my three daughters. This devise and
bequeath is made subject to the provisions of item 1 herein, and this homestead is given to the
said Emma Hambsch for the reason that she is living with and helping with care for her father
and mother.Item 6: It is my will and I hereby devise and bequeath to my daughter Rose Chamberlain,
subject to the
provisions in Item 1 hereof, the North West quarter of Section 12 in Township 27 North of
Range 52 West of the 6th P.M., in Box Butte County, Nebraska, also the South one half of the
North East Quarter of Section 25 in Township 71, North of Range 41 in Mills County, Iowa,
with the provision that the said Rose Chamberlain shall pay to my estate or assume the
payment of one half of a $4,000 mortgage now on said land last above described in Mills
County, Iowa, and the execution of my estate to pay off the other one half of said mortgage
being $2,000 in the event that sum is not paid prior to my death, and the said $2,000or one
half of the said $4,000 mortgage is made, a charge and debt against my estate in the event
the same is not paid prior to my death.Item 7. It is my will and I devise and bequeath to my daughter Mary Johnson, subject to the
provision of Item 1, herein, the South West Quarter of Section 28 in Township 27 North of
Range 50 West of the 6th P.M. in Box Butte County, Nebraska.Item 8. It is my last will and I hereby devise and bequeath to my son Louis M. Hambsch subject
to the provissions of item 1 hereof, the North West 1/4 of Section 28 in Township 27 North of
Range 50 West of the 6th P.M. in the County of Box Butte and State of Nebraska, I having
already given to my son 80 acres of land in Mills County, Iowa.Item 9. It is my will and I hereby devise and bequeath to my son, J. F. Hambsch the North
West 1/4 of Section 25 in Township 71 Range 41 West in Mills County, Iowa, with the
provision that my son J. F. Hambsch shall pay to my daughters Emma Hambsch and Mary
Johnson the sum of $4,000 in equal portions, said sum to be paid within two years from the
death of myself and the death of my wife Elizabeth Hambsch, and all deferred payments to
draw 5% interest after the same became due. This devise and bequeath is made subject to
the provisions made in item 1 hereof.Item 10. It is my Will and I hereby devise and bequeath all the rest and residue of my estate in
real, personal and mixed property, subject to the provisions contained in item 1 hereof, in
equal portions share and share alike to my four sons Charles Hambsch, Amos P. Hambsch,
Louis M. Hambsch and J. F. Hambsch, it being now my intention to depose of all my property
that I may own at my death and at the death of my said wife Elizabeth Hambsch.Item 11. It is my will and I hereby appoint, make and constitute my sons, two, Louis M.
Hambsch and Charles Hambsch, my Executors to carry out the provisions of my last Will and
Testament and I hereby revoke any and all former Wills by me made.In Witness whereof I have hereunto subscribed my name as testator this 14th day of June
1912 in the presence of A. E. Cook and of W. H. Guyer subscribing Witnesses hereto at my
instance and request.

presence of each other we saw the said testator sign and execute said last will and testament
