WILL OF LUKE TIPTON - Mills County Iowa 1869
This is the last Will and Testament of Luke Tipton of the city of Glenwood, County of Mills and
State of Iowa, and I do make and publish it not so much because the laws in force will not
depose of my estate in __?____as I desire but they do not do so in the manner I desire.Therefore I do declare that I dispose of, give, devise and bequeath all the real and personal
estate whatsoever and wheresoever of which I may die seized, possessed or entitled to as
follows:1. My just debts, if I should owe any shall first be paid and the remainder of all my property I
dispose of as follows:2. My wife Mary Tipton to have one third in value of my entire estate, real personal and mixed,
as and for her dower and in addition thereto all household goods of whatever kind.3. The remaining two thirds of my estate I give to my Executor hereinafter named, to be by him
divided between my eleven children in equal proportion, with these exceptions: 1st That my
sons (Saul?) and Charles and my daughter Palmyra, wife of William Bethel and Delila, wife of
Andrew Jackson, shall each be considered as having received from me Five Hundred Dollars
on their __?___ on one-eleventh and the same be deducted therefrom, but if the distributive
share of one-eleventh should in any event not amount to the sum of Five Hundred Dollars,
none of them shall be required to contribute back anything. 2nd That of the shares going to my
daughter Lucy Worl, wife of Amos Worl, one third thereof shall go to her daughter Mai---tha.
And with the further request that the real property shall not be divided in kind, but my Executor
shall in his own discretion as soon as he can do so to advantage, sell and convey the said
Real Estate and do any and all things necessary to turn the same into cash - requiring only of
him in making such sale and transfer, that the deeds made by my said Executor be submitted
to and approved by the property Court of Probate.I do appoint H. C. Watkins of Glenwood, Mills County Iowa, Executor of this my Will (having
never before made a will) and I authorize and empower him to compromise with and receive
from any one owing my estate less than the full amount of, if in his judgment he thinks it will be
to the interest of my estate to do so. Executed and signed by me this 22 day of October A.D.

declared by him as and for his Last Will and Testament, in the presence of us, who, at his
request and in his presence and in the presence of each other do thereunto subscribe our
names as attesting witnesses thereto.
