CIRCUIT COURT

The court has been engaged all the week in a rehearing of the case of Mary Kummer vs. John Tritz in which the fair plaintiff sues for $10,000 damages for assault and battery, charging the defendant made indecent attempts upon her person. The case was tried at a former term of court, and the jury gave a verdict of $500 damages for plaintiff. The defendant asked for a rehearing, and the plaintiff’s attorney consented. Attorneys William Graham, J. C. Murray and C. W. Farr appeared for the plaintiff, and L. A. Ellis and D. A. Wynkoop for the defendant. All testimony was taken and J. C. Murray opened the argument before the jury Thursday forenoon. He is a new and a young pleader at the bar, but makes an excellent argument. He is composed in his demeanor, choses good words and combines his sentences in a careful manner. He is a good reasoned and thrusts sharp points that agitates his opponents, those old practitioners at the bar, L. A. Ellis and D. A. Wynkoop. He commands the closest attention of the jury. D. A. Wynkoop followed Murray in an able plea for the defendant of several hours duration. L. A. Ellis also spoke for the defense on Friday and Wm. Graham closed the case last evening. The jury’s verdict will appear in the next Sentinel; also a list of other dispositions.

The jury in the case of Mary Kummer vs. John Tritz were given their charge by Judge Leffingwell, Saturday at 10 a. m., after which the court adjourned over Sunday.

It was early Sunday morning before an agreement was reached, and when the court convened the sealed verdict was opened and found to be $250 damages for plaintiff against defendant. It is said that the first ballot of the jury gave the plaintiff one vote for $2,000 damages and 10 votes for $1,000 damages. The twelfth man held out for the defendant and continued to do so for eighteen hours when they reached a compromise on the figures named in the verdict.
