August 26, 1882-If the Dubuque Herald is correct Geo. C. Heberling has been counting his chickens and before they are hatched. The announcement of his appointment to be United States Marshal came to us from one of his personal friends, and almost directly from himself. The Herald says: “O. F. Shiras, the newly appointed Judge of the United States District Court for Northern Iowa, received his commission from Washington several days ago and yesterday was sworn in by a notary public, so that now he is without a doubt a full fledged judge. Judge Shiras yesterday appointed his former law partner, A. J. Van Dukee, as the clerk of the new court. The other two officers of the court, the marshal and district attorney, will not be permanently appointed until the President sends appointees to the Senate when it meets in December. In the meanwhile he will probably make temporary nominations. The rumor that Geo. C. Heberling has been appointed marshal is a mistake. The temporary appointment for the marshalship lies in the hands of the Judge of the United States Circuit Court, Judge Miller, and he has not as yet made any appointment. Mr. Heberling, however, will undoubtedly be appointed. The Judgeship is worth $3,500 per years, and is a life position.
