Last Will and Testament of Peter Sophy

In the name of God Amen;
I Peter Sophy of Lyons Township in the County of Clinton and State of Iowa of the age of seventy eight years being of sound mind and memory and wishing to arrange my worldly affairs do make ordain publish and declare this to be my last will and testament in manner following:

1st. After all my lawful debts are paid I give and bequeath to my daughter Mary Albright the sum of Three Thousand Dollars.

2nd. I give and bequeath to the children of my deceased daughter Bridget Drey the sum of Three Thousand Dollars.

3rd. I give and bequeath to my daughter Margaret Hansman the sum of Three Thousand Dollars.

4th. I give and bequeath to my son Joseph the sum of Three Thousand Dollars.

5th. All the rest of my property real as well as personal which I may own or be in anywise entitled to at the time of my decease shall be divided in six equal shares and one of these shares shall be given to each of the following named parties to wit:
One share to my son John, one to my son Peter, and one to my daughter Mary Albright, one to the children of my deceased daughter Bridget Drey, one to my daughter Margaret Hansman and one to my son Joseph.

6th. I hereby will and direct that the sum of Three Thousand dollars bequeathed in #4 of this will to my son Joseph as well as the share falling to him under #5 of this will be invested under the direction and management of my executors, and that only the annual interest or income be paid to him the said Joseph during his lifetime, the principal to be paid over after his death to his children if he have any and if he should die without issue then the said principal to be divide in five equal shares among the rest of my children or their descendents as the case may be.

7th. My sons John and Peter having already received from me by the way of advancement various sums of money or other property and for that reason alone, “not because I love them any less”, I have given the rest of my children in this will a greater share.

8th. And lastly I hereby make constitute and appoint my son-in-law Anton Hansman and my friend B. H. A. Henningsen executors of this my last will and testament. And I here by expressly authorize them or the one that serves to sell for the purpose of settlement and distribution any real estate that I may die seized of and to make execute and deliver to the purchaser or purchasers thereof good and sufficient deeds of conveyance without intervention of any court.

In witness whereof I have hereunto set my hand this 31st. day of August A. D. 1888.

The foregoing instrument was on the day of the date thereof signed an declared by the said Peter Sophy as and for his last will and testament in presence of us who at his request and in his presence have here unto set our names as witnesses thereto.

I William Kreim, clerk of the District Court in and for said County do hereby certify that on this day at the April Term A. D. 1889 of said Court the will and instrument in writing hereunto annexed and bearing date in the 31st day of August 1888 was duly proved before and allowed by said court as and for the last will and testament of the real and personal estate of Peter Sophy late of said County deceased and was by said Court ordered to be recorded as such will and testament. In witness whereof I have hereunto set my hand and affixed the seal of the court at my office in Clinton in said County this 16th day of April day A. D. 1889.
