Last Will and Testament of Rebecca E. Thorn

I Rebecca E. Thorn of the town of Toronto County of Clinton and State of Iowa do make the following as and for my last will and testament revoking all wills and testaments hitherto made by me.

First – I allow all my just debts funeral expenses and c? to be paid.

Second – I give and bequeath William C. Thorn the East half of the North West quarter of Section Twenty two {22} in Township Eighty two {82} North of one west of the fifth principal meridian situated and being in Massillon? Township Cedar County and State of Iowa on the following conditions that he pays to his father one hundred and sixty dollars per year should I die before his father without defalcation a failure to comply with those conditions will render it void.

Third – I will and bequeath unto George W. Thorn Junior, Lots 2 & 3 & 4 in Block 4 in the town of Toronto and the peace (piece) of land between the road and the river being the north of Lot ten {10} in Section seventeen {17} Town eighty two {82} north one, east of the fifth principal meridian containing nine and one half acres be it more or less, his father is to have the use or income of the same during his life time.

Fourth – I bequeath that what ever I die possessed of in real estate not heretofore mentioned, three boys that is to say: H. C, W. C, and G. W. Thorn my sons by marriage with their father is to be equally divided between the three or the a?? sell and divid (divide) the money equally each one to recive (receive) one third thereof.

Fifth – That all the property or money that the Penfolds T. G. and A. E. Penfold are owing at the demise of me and my husband is to be divided equly (equally) on half of the same to our three sons and one half to Rushoops my brother,. My husband (if) he survive(s) me, he is to have the income theroff (thereof) as long as he lives or during his life time.
That I hereby appoint Thomas G. Penfold and Harold C. Thorn to be Executors of this will sined (signed) and sealed this 1st. day of December 1886.

We the undersigned at the request of the above named Rebecca E. Thorn sign our names as witnesses and she did in our presence sign and seal and declair (declare) the same to be her last will and testament and that at the time of so doing she was of a sound and discerning mind and memory.

I William Kreim, clerk of the District Court in and for said County do hereby certify that on this day at the Sept. Term A. D. 1888 of said Court the will and instrument in writing hereunto annexed and bearing date in the 1st day of Dec. 1886 was duly proved before and allowed by said court as and for the last will and testament of the real and personal estate of Rebecca E. Thorn late of said County deceased and was by said Court ordered to be recorded as such will and testament. In witness whereof I have hereunto at my hand and affixed the seal of the court at my office in Clinton in said County this 12th day of Sept A. D. 1888.
