Last Will and Testament of Richard Myat

I Richard Myat of Clinton County in the State of Iowa being of sound and disposing mine and memory of the age of seventy seven years do hereby make and ordain this my last will and testament revoking all former wills made by me.

First – I give my soul to God and after all my lawful debts and funeral expenses are paid, I give devise and bequeath unto my beloved wife Elizabeth Myan during her natural life all my real estate and one third of all personal property with statutory amount of household and kitchen furniture included and the remainder to my son Henry Myat subject to the following legacies and other conditions hereinafter named to wit: To Ann Crain, Elizabeth Teeple and Martha Myat my three daughters, Five hundred ($500.) each to be paid as follows, one hundred dollars each one year after the death of my said wife and every second year thereafter one hundred dollars each until each shall receive Five hundred dollars without interest. My said son Henry shall pay any of said legacies before the death of my wife or before they are due according to the above provisions. He shall pay every one hundred dollars with ninety five dollars. My daughter Martha shall have a settled home with my said wife until she shall be married and well settled in life. I also subject my said son Henry to the following condition that is upon the payment to me or my executor of three hundred and fifty ($350.) dollars and int. from 10th day of October 1879 by my son Arthur Myat then my said son Henry shall execute a clear deed to the undivided one half of one hundred and five acres of land claimed and in possession of my son Arthur Myat to said Arthur. It being the intention that said Arthur shall have all of said tract upon the payment for same. My said wife or if she be dead my son Henry shall furnish my said daughter Martha Myat at her marriage with a set(t)ing out for housekeeping in manner and value to my other two said daughters outfit.

Executed at Sharon Township in Clinton County in the State of Iowa this 14th day of January A. D. 1880.

The foregoing instrument at the date thereof was signed by Richard Myat in our presence and be at the same time declared the same to be his last will and testament and by his request we signed our names as witnesses these both in his presence and in the presence of each other.

I William Kreim, clerk of the District Court in and for said County do hereby certify that on this day at the Sept Term A. D. 1888 of said Court the will and instrument in writing hereunto annexed and bearing date in the 14th day of January 1880 was duly proved before and allowed by said court as and for the last will and testament of the real and personal estate of Richard Myat late of said County deceased and was by said Court ordered to be recorded as such will and testament. In witness whereof I have hereunto at my hand and affixed the seal of the court at my office in Clinton in said County this 12th day of Sept. A. D. 1888.
