Last Will and Testament of John Fahey

I John Fahey being of sound mind and lawful age do make this my last will and testament.

I give devise and bequeath unto my wife Mary A. Fahey for and during her natural life the use and benefit of my real estate and at her death the said property shall go in equal shares to my children but my said wife shall not sell my residence property situated on the corner of Pearl and 7th Street in Buelle Addition in Lyons City during her natural life.

Item 2 – I give devise and bequeath absolutely the life insurance I now have to my wife Mary A. Fahey.

Item 3- It’s is my wish and desire that my wife shall build a kitchen to my residence and finish of the upstairs from the insurance money I may leave at my death.

Item 4 – I also direct that should it every become necessary for my wife to sell any part of my real estate for the support of my family and children that she be permitted to seel the same and give perfect title thereto, the house and lots I now own in Buell’s Addition situated on the corner of 10th Street and 2nd Avenue. Provided that she shall first obtain an order of the Probate Court of Clinton County Iowa decreeing that in the judgment of said court it is advisable for her to sell such property.

Item 5 – I hereby appoint and constitute my said wife sole executrix of this my will and appoint her guardian of my said children and exempt her from giving bonds as such guardian or Executrix.

On this 11th day of February A. D. 1888 the foregoing instrument was in our presence signed and executed by John Fahey and by him declared to us to be his last will and testament and at his request and in his presence and in the presence of each other we have subscribed our names as witnesses.

I William Kreim, clerk of the District Court in and for said County do hereby certify that on this day at the April Term A. D. 1888 of said Court the will and instrument in writing hereunto annexed and bearing date in the 11th day of February 1888 was duly proved before and allowed by said court as and for the last will and testament of the real and personal estate of John Fahey late of said County deceased and was by said Court ordered to be recorded as such will and testament. In witness whereof I have hereunto at my hand and affixed the seal of the court at my office in Clinton in said County this 5th day of May A. D. 1888.
