Harvey Lincoln Luce

Obituary:
January 1927

Mr. Harvey Luce passed away Monday night after being in the Hospital just six days. It will be remembered that he had come from his home on Yellow River, and was a guest at the home of his nephew, Floyd Luce.

While walking in the yard at Floyd's Tuesday evening, January 4th. a neighbor, Willard Minney saw him and not recognizing him, and thinking he was a prowler, shot Mr. Luce with a shot gun. He was immediately taken to the Hospital, where he was given every possible care. Dr. Meggers had expected to operate on Mr. Luce for a long standing cancer trouble, but after the shock of the shooting and the numerous shot which entered his back and limbs, it was not possible to operate, and he passed away Monday night.

Coroner Beerman was called, and empanelled a jury consisting of Jas. McLaughlin, E. L. Spaulding and Jack Kramer. The verdict reached was that Mr. Harvey Luce died from weakness caused by cancer, and accidental shooting." The Jury exonerated Willard Minney.

Mr. Harvey Luce was 66 years of age, and has lived in this vicinity all his life, making his home with his brother, Mr. Phil Luce, on Yellow River. He was an honest upright and industrious citizen, and his death is mourned by all who knew him.

He is survived by his brother Phil, one son, Milton, of Kansas, and several nephews and nieces. He was a brother of the late Hon. C.A. Luce.

Milton Luce arrived here Monday in time to see his father alive. The funeral services will be held Thursday afternoon, burial in Pleasant Grove Cemetery.

Clayton County Register, Thur., 13 Jan. 1927. From the Dubuque Telegraph Herald, Dubuque, Iowa, undated.

The following is taken from the Dubuque Telegraph Herald:

Gunshot wounds received the night of Jan. 4 were given as a contributing cause of death of Harry Luce, 66, who died at the McGregor hospital early Tuesday morning. Mr. Luce, whose home is at Yellow Ridge, a place near McGregor, came to that place a week ago to the home of his nephew, Floyd Luce, intending to take treatment at the local hospital.

On the night of Jan. 4 Willard Minney, a neighbor of Floyd Luce, saw someone walking about the yard near his home and was convinced it was a prowler. He got his gun and ordered the man to put up his hands and thinking he detected a motion by the stranger which indicated he was reaching for a gun in his hip pocket, Mr. Minney fired his shotgun at the man in the yard. The charge struck Mr. Luce in the back and in his legs. He was at once taken to the hospital.

Coroner Beerman, of Guttenberg, was called Tuesday morning and an inquest was held. The verdict declared that Mr. Luce came to his death as a result of a cancer, with the gunshot wounds as a contributing factor. No charges were placed against Mr. Minney.

The victim is survived by a son at Hays City, Kansas, and a brother at Yellow Ridge. The funeral was held Thursday.
