LAST WILL AND TESTAMENT OF JOHN H. BALL
I, John Ball, of Cherokee, Cherokee County, Iowa, being of sound mind and memory, do now make, publish and declare this to be my last will and testament, hereby revoking any and all wills by me at any time heretofore made.

Item 1. It is my will that all my just debts and funeral expenses be first paid out of my estate.

Item 2. It is my wish to be buried in Oak Hill Cemetery at Cherokee Iowa, and to that end it is my desire that my wife select a suitable lot in said cemetery and after my burial to erect thereon an appropriate monument to be paid for out of my estate.

Item 3. I hereby will, devise and bequeath to the trustee or to the person who shall at the time of my death be authorized by law to receive such funds and to his successors in office the sum of two hundred Dollars ($200) to be a permanent fund in his hands to be loaned as provided by law and the proceeds therefrom to be used in keeping the said cemetery lot and monument in good condition and in beautifying and adorning the same.

Item 4. All the rest, residue and remainder of my estate both real and personal and wherever the same may be situated I will, devise and bequeathe unto my dear wife, Kate Ball to be hers absolutely.

Item 5. I hereby nonimate and appoint my said wife Kate Ball to be the executrix of this my last will and testament and request that she be required to give no bond.

On this 29th day of August A. D. 1904, the above and foregoing will was signad and executed before us and in our presence by the said John H. Ball, and in our presence he declared the same to be his last will and testament and in his presence and in the presence of each other and at his request we have signed the same, A.C. Hobart and James H. Clark as witnesses thereto.

I, Ben Ballou, Clerk of the District Court of the State of Iowa, in and for Cherokee County, do hereby certify that the foregoing last will and testament of John H. Ball, deceased, was on the 31st day of October 1904, duly proved and admitted to probate and record in said Court in accordance with law.

In testimony whereof I have hereunto set my hand and affixed the seal of said court at my office in Cherokee in said County on this 31st day of October A. D. 1904.

Affidavit of Deceased
State of Iowa, Cherokee County

I, Kate Ball do solemnly swear that I was acquainted with John H. Ball, during his lifetime, and that he departed this life at Cherokee in the State of Iowa the 3rd day of Oct. A. D. 1904.
