Farmington man charged in connection with death
Charged with homicide by vehicle

Nearly six months following an accident which claimed the life of a 16-year-old girl, a rural Farmington man has been arrested and charge with homicide by vehicle in connection with the incident.

Gary Lee Seth, 23, was arrested Tuesday, December 26, by Iowa State Patrol officers on a warrant issued by Van Buren County Sheriff's office and the State Patrol.

Kelli Anne Shark, 16, of Amarillo, Texas was killed July 4 at approximately 11:25 p.m. when a pickup truck driven by Seth overturned on a county blacktop road near Bentonsport. She was back with her family visiting Bonaparte relatives over the holiday weekend.

Shark, Seth and another passenger, Frank Dale Hackard, 17, of Farmington, were thrown from the vehicle when it failed to negotiate a curve approximately 1/4 mile south of the Bentonsport bridge.

Hackard was treated for minor injuries at Van Buren County Hospital and released. Seth was seriously injured and was air-lifted to Iowa City for treatment there. Shark was pronounced dead at Van Buren County Hospital by Medical Examiner Dr. James Worrell.

According to the information to the information, filed by Van Buren County District Court by County Attorney Richard H. Lytle, Seth is accused of unlawfully, and unintentionally causing the death of Shark by operating a motor vehicle under the influence of an alcoholic beverage and/or drug, or a combination of such substances, and/or while having an alcohol concentration of .10 or more.

Seth's bond is set at $5,500 by District Court Judge James Jenkins, but he was released December 27 on his own recognizance and ordered not to leave Iowa or Missouri without written consent of the court.

He is scheduled to be arraigned January 19 at 10:15 a.m.

Homicide by vehicle is a Class D felony and carries a maximum penalty of five years in prison and a fine of $7,500.
