The Last Will and Testament of Thomas Whitaker of Des Moines Township Van Buren County State of Iowa
I, Thomas Whitaker do make and publish this my last will and testament in manner and form following, to wit;
1st, I will and bequeath unto my niece Mary Brook the North West quarter of the southwest quarter of Section No. twenty-three in township No. sixty eight North of range No Ten West containing forty acres; and likewise the south west quarter of the south west quarter of Section no. twenty three Township No. sixty eight North of range No. Ten West of the 5th P.M. containing forty acres with the house and appurtenances thereunto belonging during her natural life, and at her decease to be equally divided betwinst her two children Sarah Ann Brook and Nicholas Johnson Brook if living at her decease and if only one living to such only child; and in case neither be living at her decease to go to my sister Harriet Brook children herein after named living at her decease share and share alike; and furtheer will and bequeath unto my said niece Mary Brook one horse five cows, five hogs, fifty bushels of oats, all the hay bees and poultry or the value equivalent thereunto for her own sole and private use and benefit, and all furniture.
2nd, It is my will that my sister Elizabeth Johnson shall have all my monies which is due or may hereafter become due from the will of my late Uncle Samuel Nicholson Deceased of Rawiliffe in the parish of Snaith and County of York, England, if living at my decease and in case of her death in the meantime then to go to her children living at my decease share and share alike
3rd, It is my will that all my remaining goods, chattels and effects as shall belong to me at the time of my decease shall be sold and that the proceeds of such sale after paying all my just debts together with my funeral expences and all charges touching the proving of or otherwise concerning this my will shall in the first place be fully satisfied and paid, shall be equally divided amongst the following named children of my sister Harriet Brook to wit; Samuel Brook, William Brook, Harriet Burns, George Brook, Luke Brook, Eliza Brook, Henry Brook share and share alike to be paid and delivered to the said several legates above mentioned as they respectively become of age.
4th, and lastly I make and ordain William Wrigglesworth Executor and Henry Singleton Guardian of this, my last will and testament hereby revoking all former wills by me made.
In witness whereof I have hereunto set my hand and seal this fourth day of September in the year of our lord one thousand eight hundred and fifty two.
