PAULY HOSPITAL AND ESTATE WILLED TO KAHOKA
The will of the late Dr. W.F. Pauly has been read and filed in the Probate Court under date of May 31, and under its provisions, his hospital on West Main street and his estate have been left to the City of Kahoka.
The will is dated Jan. 29, 1949 and is witnessed by Harry E. Gates and Ellis C. Brown. Omitting repeating the usual introduction in which he directs the paying of all debts and funeral expenses, he requested that he be buried in the Bear Creek cemetery, Clark county, Mo.
In clause 2, he directs the sale of all property of any kind except the hospital.
Clause 3 is in part as follows:
I, believing that the City of Kahoka, Missouri, should have a hospital and that it would be for the best interests of the citizens of said city and surrounding communities if one be established and being desirous of having one son established and being desirous of giving devising and bequeathing all of my property, subject to clause one (payment of debts) **. To hereby establish the W.F. Pauly Hospital Foundation for the purpose of owning, operating and maintaining a hospital in the City of Kahoka, Missouri. Said Foundation to be managed and operated by a Board of Trustees, one to be selected by each of the following churches in the City of Kahoka, to-wit: Baptist, Catholic, Christian, Methodist, St. Pauls Evangelical and Presbyterian. Said Trustees shall hold office, one third for one year, one third for two years and one third for three years from the first day of June following their appointment, and at their first regular meeting shall act without pay but are to be reimbursed for all moneys necessarily paid out for the benefit of said foundation. They may receive and hold funds raised from other sources for the benefit of said trust. Said Trustees shall maintain and operate the W.F. Pauly Hospital in the City of Kahoka, Missouri. They shall make such improvements and additions thereto as they deem proper. They shall employ all professional and other help, and, generally, have full charge of the maintenance and operation thereof, including the determination of the charges for the services there-in rendered.
Clause four directs that if the operation of the hospital of a hospital is unwise the trustees are authorized to close the building as a hospital and to establish and maintain and operate "An Old Folks Home" or the said trustees may operate the building as both a hospital and a home. In the event neither is practical the property shall be sold and the proceeds be turned over to the Chapter of Infantile Paralysis, the funds to remain in Clark county.
Clause five appoints Jos. L. Gutting of Kahoka Executor. No attorney fee is to be charge against the estate.
It is generally understood that Dr. Pauly has real estate, much livestock and other assets. - Clark Co. Mo. Courier.
