Judge Edward E. Wagner of Mitchell, South Dakota died last Friday.

Judge Wagner was the first white child born in Lyon County, Iowa but moved to Davison County, South Dakota in early manhood and for many years was a successful practicing attorney at Alexandria. Later he moved to Mitchell where he continued the practice of law. He was appointed federal district attorney for South Dakota by President Theodore Roosevlt in 1907 after which he moved to Sioux Falls, later returning to Mitchell after practicing law in Sioux City for a time. He was elected to the circuit judgeship in Davison County in 1934.

He was a brother of the late Hulbert D. Wagner, former Hawarden resident and was well known to numerous Hawarden people.

He is survived by his widow, Emily (Watt) Wagner; two daughters and one son.
