INSTANTLY KILLED BY AUTO

Albert Timmer Struck by Car Driven by Frank Johnson

Albert Timmer, the nine-year-old son of Mr. and Mrs. Dick Timmer, residing two miles east of Hudson in Garfield township, was instantly killed Tuesday forenoon by being struck by an automobile driven by Frank Johnson who also resides in the same vicinity. No blame attaches to Mr. Johnson for the unfortunate accident. He was driving by what is generally known as the John Johnson school house at recess time and a number of the boys deliberately ran across the road in front of the oncoming machine. Little Albert Timmer failed to get across in time and was struck by the car. Mr. Johnson made every effort to stop his car and did it so suddenly that his own daughter who was riding with him was thrown out and was quite badly bruised. The lad was carried into the school house but the spark of life had flown before they reached the building with the body. Mr. Johnson is deeply affected by the tragedy, but no one blames him in the least for the accident.

The Anderson school district, adjoining Hudson on the east side of the Sioux river, was the scene Tuesday of a very sad accident. Frank Johnson was passing with his auto where the school children were at play, when Dick Timmer's seven year-old son ran across the road in front of the machine. He was run over and so badly hurt that he only lived a very short time. The auto was badly used up.

Alton Democrat issue of 11 October 1913:
Albert Timmer, aged 8 years, living one mile east of Hudson, S.D., in Sioux county, was run over Tuesday by Frank Johnson in an automobile, so that he died within four hours. Albert, with some other children, was playing in the road in front of the country schoolhouse. Johnson, as he saw them, blew the horn. Some of the children ran to one side of the road and some to the other. Albert, at first undecided what to do, finally started across the road directly in front of the auto and was struck at the base of the skull by a lamp and the fender. The accident happened at 1:05 P.M. The decision of the coroner's jury follows: "Albert Timmer came to his death by accidentally being struck by an auto driven by Frank Johnson. In our opinion said Frank Johnson was not using due care and was driving his automobile faster than he should while passing the schoolhouse." Johnson testified that he was driving 15 to 20 miles an hour and did not slack up while passing the schoolhouse for fear the boys would try to catch on. He also said that he threw the brake on which caused his daughter, who was with him, to be thrown forward in such a manner as to knock his foot from the brake.

Dr. Gleysteen, in the capacity of coroner, Bert McWilliams and M. D. Gibbs, autoed to Hudson, S. D., Wednesday where Dr. Gleysteen conducted the trial by an inquest jury of Frank Johnson who ran into and and killed Albert Timmer, aged 8 years, with his automobile.

Garfield Greetings--A large number of friends and neighbors dropped in on Mr. and Mrs. Dick Timmer Saturday evening and gave them a very pleasant surprise. Mr. Timmer is an honest and upright man who has met with many trials and tribulations, their last bereavement being the loss of their son Albert who was killed in an auto accident. They were given a purse of a little better than $200. Miss Lynda Tosseland honored them with a speech which comforted them very much. Refreshments consisting of sandwiches, cake and coffee were served.

Dick Timmer has filed a suit in the district court of Sioux county for $5,000 damages against Frank Johnson for the death of his little son Albert who was killed by an auto driven by Mr. Johnson while playing in the road in front of the school house about three weeks ago. Mr. Timmer brings the suit as administrator of the estate of his son.

Frank Johnson of Hudson has been sued for $5000 damages by Dick Timmer, father of the little boy who was killed by the Johnson auto as it was passing the rural school house east of Hudson.

Dick Timmer whose son, Albert, was killed by an auto driven by Frank Johnson at a school house near Hudson a few weeks ago, has filed suit in the district court in Sioux county against Mr. Johnson for damages amounting to $5000.

From the Hawarden Independent, Hawarden, (Sioux), Iowa, January 22, 1914, Page 1:

The damage suit for $5,000 brought by Dick Timmer against Frank Johnson for the loss of his son who was killed in an automobile accident in Garfield township last summer, was settled out of court at Orange City Wednesday. It will be remembered that in driving past a school house in Garfield township with his automobile Mr. Johnson ran over the little son of Mr. and Mrs. Timmer and the boy died shortly after the accident. The plaintiff alleged that the defendant was driving at too high a rate of speed and did not use the precaution that he should in passing the school grounds where the children were at play. The matter was settled just before the case was called for trial, the defendant agreeing to pay a sum that was satisfactory to the plaintiff.
