Ask Quarter Million in Damages, Claiming Patent Infringement
Attorney Bush Files Suit with U.S. Court at Peoria for Estate of James N. Burris of Davenport, Inventor of Non-Skid Vehicle Tire Attachment.
Asking more than a quarter of a million dollars damages for alleged infringement of patent rights on a non-skid vehicle tire attachment, Attorney A. G. Bush of Davenport has filed suit for H. E. Voss, administrator of the estate of James N. Burris, against the Bear Manufacturing company of Rock Island thru the southern Illinois U.S. district court at Peoria.
The estate of the Davenport man is demanding $257,466.80 on three separate matters concerned in the alleged violation, according to the papers filed at Peoria, and contractney [sic] Harry L. Fisher of Muscatine, who is acting with him in the case.
James N. Burris of Davenport, who died in September, 1919, was the inventor of an attachment to take the place of chains in use on automobile tires. He secured the patent rights, it is asserted in the papers filed at Peoria, and contracted with the Bear Manufacturing comopany of Rock Island to Manufacture the attachments on a royalty basis.
Later the Rock Island company cancelled its contract with Burris, it is asserted, and at the time $7,466.80 in royalties were due.
Since that time it is also alleged that the Bear Manufacturing company has continued to manufacture and sell large quantities of the attachments at a profit to the company declared to be $100,000. This amount is demanded on that score.
Further damages of $150,000 - a three-fold damage of $50,000 - is demanded because of the alleged infringement which is declared to be deliberate and willful.” Burris was very well known in Davenport.
