Neck Broken When Jammed In Door

Joe Neary, 64, who has been working at various odd jobs around Akron, was killed instantaneously about 5:30 p. m. Sunday when his car ran off the grade 2 miles north of Akron on Highway 12. He suffered a broken neck.

Mr. Neary was driving a Chrysler two-door sedan, and left the road rather gradually, as shown by the tracks on the soft gravel shoulder, Sheriff Frank Scholer deduced. The car rolled over and the rear end hit a telephone pole. The car hit pretty hard, Coroner S. H. Luken said, as the seats and contents of the interior were jumbled around. He said apparently the door flew open. Mr. Neary was thrown partly out, and then the door slammed shut and jammed, imprisoning the victim's head and neck.

A doctor and priest were called from Akron by a passerby. They called the coroner and sheriff. With the help of volunteers, they were able to pull the jammed door open and release the body.

The nearest to an eye-witness account was given to the coroner by Dick Frerichs and his wife who did not see the accident. but were apparently the first to come along after it happened. "We saw the car." said Mr. Frerichs, and then we saw the driver. We went over there. Mama tried speak to Mr. Neary, but he wouldn't answer, and we knew he was dead,"

The body was taken to the Rossow Funeral home at Akron, and the sheriff and coroner reported the accident to the Le Mars police station for transmittal to the highway patrol.

Mr. Neary was apparently on his way to the Bill Ross farm, not far from the accident scene, where he lives. He had a brother, Ed at Beresford, S. D. and a nephew, named Ross in the F. B. I. Also several other nieces and nephews.

Deceased was born February 4, 1889, in Union County, S. D., and had lived around Akron his entire life.

Funeral services will be held Wednesday. January 20, at 9:00 a. m. at St. Mary's Catholic Church in Akron with Rev. J;. C. Skahill officiating. Burial will be in Akron cemetery under direction of Rossow Funeral Home. The rosary will be recited at 8:00 p. m. at the funeral home on Tuesday.

AKRON MAN KILLED IN AUTO ACCIDENT NEAR HERE SUNDAY
Joseph W. Neary Dies When Auto Leaves Road And Strikes Pole

Joseph W. Neary, a resident of Akron vicinity practically all of his life, met death late Sunday afternoon when the car he was driving left the highway on No. 12, about two miles north of town, and overturned in the ditch. After overturning, the car apparently rolled over the grade leading into the W. B. Ross farm yeard and crashed into the telephone pole. There was no eye-witness to the accident but first on the scene were Mr. and Mrs. Dick Frerichs, of this vicinity, who were driving by. They investigated and found that Mr. Neary was dead and evidently had been instantly killed. He was partly out of the car, his head and neck being caught between the door and frame. Sheriff Scholer and Corner Luken were called from LeMars to the scene and the body was removed to the Rossow Funeral Home.

It is understood that Mr. Neary, who was employed here in town, was enroute to the farm of his brother-in-law, Wm. B. Ross is spending the winter in California, to look after home matters on the farm. Joe as he was generally known, was a moderate driver, and there is a supposition he may have seized with some sort of a stroke that caused him to lose control of the auto before it left the highway, and there would have been no occasion to speed up as he approached his destination.

Joseph W. Neary was born February 4, 1889, in Union county, S. D., the son of Mr. and Mrs. Patrick Neary, early day residents of this vicinity. He assisted his parents on the farm during their lifetime.

He is survived by his brother, Ed Neary, of Beresford, S. D., and a number of nephews and nieces, to who the community offers, sympathy in their bereavement.

His sudden passing came as a shock to them and his many friends.

Funeral services were held yesterday morning at 9:00 o’clock in St. Patrick;s Catholic church, Rev. Fr. J. G. Skahill officiating. Burial was in the Catholic cemetery.
