AFFIDAVIT: PETTITT

AFFIDAVIT: May 1950.

I, Albert Halvorson being first duly sworn on oath, depose and say that I am a resident of Mitchell County, Iowa, and that I am of legal age. That I was well and personally acquainted with Ernest E. Pettitt the mortgagee in a certain real-estate mortgage executed by Sylvin A. Glassel and Hazel I. Glasel, which mortgage was dated March 1, 1944 and was in the original amount of $9,000.00, was filed for record on May 16, 1944 and recorded in Book 60 of land mortgages on page 212, records of Mitchell County, Iowa, and which mortgage covered the following described real-estate:
A parcel of land bounded by a line commencing at a point 90 rods North of the SE corner of the NE 1/4 of Section 30, 100, 18, thence North to the NE corner of said Quarter Section 30, thence West to the Right of way of the Chicago Great Western Railway, thence in a Southwesterly direction along the said Right of Way to a point directly West of the place of beginning, thence East to the place of beginning containing 40 acres more or less; and the South 90 acres of the NE 1/4 of Section 30, 100, 18.

I do further state that the said Ernest E. Pettitt died at Northwood, Iowa on December 24, 1948, leaving no Last Will and Testament; that his estate has not been probated; that he was survived by his widow Ethel B. Pettitt, age 68, Northwood, Iowa and the following five children who constituted his sole and only heirs at law: Albert W. Pettitt, Austin, Minnesota, Charles E. Pettitt, Charles City, Iowa, Oliver C. Pettitt, Kensett, Iowa, Eleanor Sheumaker, Otranto, Iowa, Dorothy Olson, Northwoood, Iowa.

I do further state that each of said children is of legal age, that the debts of said Ernest E. Pettitt, including expenses of last illness and burial, were paid in full and that his estate was not in a sufficient amount to be subject to any inheritanc taxes.

I do further state that said mortgage was not completely paid off until after the death of the said Ernest E. Pettitt but that I know of my own knowledge that it has been paid in full.

Further deponet sayeth not.
