Farm Warehouse Certificate
Department of Agriculture, State of Iowa
Owner’s Application Statement and Agreement

Dated Feb 7, 1938 Consecutive Certificate No. 37531D

To the Mills County Warehouse Board Number 65 (Amount applied for $485.00)
The undersigned owner hereby makes application for a granary, bin or crib, located on land hereinafter described, to be sealed, and for a farm warehouse certificate to be issued theron under the provisions of Chapter 427, Code of Iowa, 1935, and for the purpose thereof makes affidavit as follows:
State of Iowa
County of Mills

I, the undersigned owner, upon oath depose and say: that I am the owner of the grain covered in this application for a farm warehouse certificate, as Sale Owner.

That the granary, bin or crib is located on the following described real estate, to wit; ? E. ¼ on the N.E. ¼ of Sec 13, Twn. 71, Rng. 40, County of Mills, State of Iowa, owned by J.O. Hamaker said land being located 1 N. from Strahan, Iowa

That said grain is free and clear of all liens and encumbrances both statutory and contractual, except: None

That no other certificate has been issued covering said grain except: None

That I am married and the name of my spouse is: Widower

That the amount of grain specified in this certificate, and the kind, grade and quantity thereof are correct, and that said grain has been sealed as therein provided.

That I will not remove any of the grain covered by this certificate, or break the seal on the container therof, except upon written authorization of the holder of the original farm warehouse certificate; that the granary, bin or crib is of good construction for retaining and protecting the grain from the weather and has adequate facilities for ventilation; that any loan secured by the farm warehouse certificate, being in default, I will upon demand deliver said amount of grain to the holder of the certificate, or order, to be issued theron, at such grain elevator or other place, reasonably convenient for delivery, as may be designated by the holder of this certificate; and failing to make such delivery I will permit holder, or his agent, to enter on the premises and remove said grain and charge the expense of removal and delivery against the sale proceeds.

Waiver By Spouse
I, Widower, spouse of owner of the grain described in this certificate do hereby, with full knowledge, freely consent to the terms and conditions of said certificate, and waive any and all claims of exemptions to the grain therin specified, which I may have.

Sealer’s Verification
Dated Feb. 7, 1938 (Amount applied for $485.00.
Upon the sworn application of J.O. Hamaker, of Strahan, Iowa, Mills County, Iowa, this farm warehouse certificate is issued by the Mills County Warehouse Board number--, to the above named party on the representations and agreements contained in the owner’s application, statement and agreement which is a part of this certificate.

The undersigned, official sealer of the Department of Agriculture, State of Iowa, hereby certifies that he has verified the existence of the above mentioned granary, bin or crib and that the location as set forth in the owner’s application, statement and agreement is true and correct, that he has to the best of his ability verified all other information contained in the owner’s application, statement and agreement and believes it too be true and correct; further, that he has measured and inspected the grain contained in said grainary, bin, or crib, and sealed same that it contains 970 bushels (by measurement and not by weight of yellow,(kind of grain), which he believes will grade 3; that he has inspected the granary, bin or crib and finds it to be of good construction for retaining, ventilating and protecting the grain from the weather. The crib or receptacle is described as: Size 21’ x 9’ x 8 ½ Construction- frame, Condition of Roof-- fair, Condition of floor—good, Distance of floor from ground-- 10”.

The undersigned, official sealer of the Department of Agruculture, State of Iowa, also certified that both himself and the applicant are familiar with and have a knowledge of the provisions of Section 9752-g29 of the Code of Iowa, 1935, which states, “An owner, the agent or servant of an owner, or any member of any board, or any sealer who fraudulently issues or aids in fraudulently issuing a certificate for grain, knowing that it contains any false statement shall be guilty of a misdemeanor, and upon conviction shall be punished for each offense by imprisonment in the county jail not exceeding one year, or by a fine not exceeding one thousand dollars, or by both.”

Thereupon, this granary, bin or crib is declared to be sealed and this Warehouse Certificate issued under the provisions of Chapter 427, Code of Iowa, 1935.
