Will of Shepherd Cary

The Last Will and testament of Shepherd Cary:
I, Shepherd Cary, considering the uncertainty of this mortal life and being of sound mind and memory do publish and make this my last will and testament in manner and form following, that is to say:

First: I give and bequeath unto my second wife’s four children to wit: Andrew Blunt, Sarah Elizabeth Blunt: Thomas S. Blunt and Mary Etta Blunt each of the above persons to have Fifty Dollars, and I give and bequeath to my step-son Samuel A. Williams Fifty Dollars. Said Fifty Dollars is to be credited on a certain promissory note that I hold against him for $128.85 and due twelve months after date, dated May the 18th, 1875. And lastly I give and bequeath all the rest residue and remainder of my personal estate, goods and chattels of what kind and nature soever, I give to my son Crawford Cary and my Grandson William B. Blunt to be equally divided between them and I hereby appoint Crawford Cary my son as administrator this Last will and testament.

In Witness whereof I hereunto set my hand and seal the 17th day of May, 1882.

The above instrument consisting of one sheet of legal cap was now here subscribed by Shepherd Cary, the testator in the presence of each of us and was at the same time declared to be his last will and testament and we at his request signed our names thereto at his request.

STATE OF IOWA, Mills County ss

I, J.E. Robinson, Clerk of the Circuit Court, hereby certify that an instrument purporting to be the last Will and Testament of Shepherd Cary of Mills County, Iowa, was presented, read and filed on the 24th of November, 1882; that notice was published for its Probate in the Hastings Plaindealer a weekly newspaper in Mills County, Iowa, three consecutive weeks, the last publication being ten days before the time appointed for its probate; that on said time appointed, the execution of said will was duly approved by the subscribing witnesses thereto; and also that the said testator at the time of its execution was of full age, sound disposing mind and memory, and free to act. It was then and there adjudged and ordered by the court that the aforesaid instrument was duly executed and that the same be admitted to Probate as the last Will and Testament of Shepherd Cary and that letters testamentatary issue to the Executor named therein in accordance with which Crawford Cary Executor named in said will, were appointed to carry its provisions into effect.

IN WITNESS WHEREOF, I have attached the seal of this Court and subscribed my name this 17 day of May, 1883, J. E. Robinson, Clerk of Circuit Court.
