I, Harriet Sidener of Mills County, Iowa being of sound mind and memory and being unmindful [sic] of the uncertainty of life do make and declare this my last will and testament. I direct that my just debts and funeral expenses be first paid, and I direct my legal representative to erect a monument at the grave of my son Martin F. Sidener in the cemetery at Silver City, Iowa, and for that purpose, I authorize and direct him to set the sum of one hundred dollars, out of the first money coming into his hands.

To my daughter, Sarilda J. Spencer, I devise and bequeath my homestead it being lots two (2) and three (3) in Block Twenty three (23) in the town of Silver City, Iowa according to the recorded plat thereof.

I give devise and bequeath to my son E. L. Sidener and to my daughter Rachael Smawley and Abie C. Harrison rest, residue and remainder of my property to be equally divided and all notes or other demands due me, from any of my said children shall be inventoried as assets of my estate and should be considered in making such division whether said notes or any of them are barred by the statute of limitations or not.

I hereby appoint and name J V. Hinchman of Glenwood, Iowa my executor under this will and I hereby revoke any and all other wills I may have heretofore made.

Witness my hand this 30th day of October A. D. 1891.

At the date above named at the request of Harriet Sidener we sign our names as subscribing witnesses in her presence and in presence of each other. At time of signing of said will she declared the same to be her last will and testament and was of sound mind and memory.

Whereas I, Harriet Sidener of Silver City, Iowa, have made my last will and testament in writing bearing date the 30th day of Oct A. D. 1891 in and by which I have give and bequeathed to my daughter Sarilda J. Spencer my homestead being lot two (2) and three (3) of Block Twenty three (23) in the town of Silver City, Iowa according to the recorded plat thereof.

Now, therefore, I do by this writing which I hereby declare to be a codicil to my last will and testament and to be ____taken as a part thereof order and declare that my Executor J. V. Hinchman shall sell my farmstead and add the proceeds to the balance of the estate of which I may die seized.

Then, I give divise and bequeath unto my sons E. L. Sidener and S. G. Sidener and my daughters Rachael Smawley, Sarilda J. Spencer and Abie C. Harrison all of said property subject to all the other conditions of my former will and testament herein referred to to share and share alike hereby revoking that part of said former will as to the bequest of homestead to Sarilda J. Spencer

In witness whereof I have here unto set my hand this 7th day of March A. D. 1893.

The above codicil to the Harried Sidener’s will to which it is attached on one sheet of legal cap paper at the date thereof was signed and declared by the said Harriet Sidener as and for her last will and testament in presence of us who at her request and in her presence subscribed our names as witnesses thereto.

STATE OF IOWA, Mills County,---ss.

I, C. C. Potter Clerk of the District Court, hereby certify that an instrument purporting to be the last Will and Testament of Harriet Sidener of Mills County, Iowa, was presented, read and filed on the 14th day of December 1893; that notice was published for its probate in the Glenwood Opinion a weekly newspaper in Mills County, Iowa three consecutive weeks, the last publication being ten days before the time appointed for its probate; that on said time appointed, the execution of said will was duly approved by the subscribing witnesses thereto; and also that the said testator at the time of its execution was of full age, sound disposing mind and memory, and free to act. It was then and there adjudged and ordered by the court that the aforesaid instrument was duly executed and that the same be admitted to Probate as the last Will and Testament of Harriet Sidener.

IN WITNESS WHEREOF, I have attached the seal of this Court and subscribed my name this 18th day of May 1894.
