I, Samuel Mershon, do this day make this instrument as my last will and testament.

After my death, my estate shall remain as "The Samuel Mershon Estate." I do herewith bequeath to my beloved wife, Catherine, all the net income realized from the Estate during her life time.

After her death, all accounts collected and all debts paid. One thousand Dollars shall be held by the Administrator, to be used by him in paying our funeral expenses, buying tombstones, fixing up burial lot, and keeping the same in order.

If no settlement can be agreed upon between my three children, viz Byron, Jacob B. and Lilly M., then all property, real and personal shall be sold, and the net proceeds noted for a division.

I wish it understood that I do not aim in any way to touch upon the way in which my beloved wife may dispose of her property, or property in her name. But, in order to get at the amounts which I desire to bequeath to each child from my estate, the values of all the property this day owned by either of us, myself or wife, all properties hereafter acquired by either of us or our estates before the death of both of us, shall be added together. From this amount deduct and pay to each child, any just amount or reasonable account they may present for services rendered, money paid or assistance given us, or improvements on property, by our consent. Divide this balance into three equal parts. Deduct from each part, the value or amounts that each child has received or will receive in any way. The remainder in each case will represent the amount of my estate, that I do hereby bequeath to each of my two sons, Byron and Jacob B. and to my daughter Lilly May, my intention is that all the children of myself and wife, now living or at time of death of us both, shall share equally in the estate saved and accumulated by us both during our married life.

And I do hereby appoint my son Jacob Burnside Mershon to act as the Administrator of my estate, without bonds, and at a legal compensation, until a final settlement is made. Signed Samuel Mershon
