WILL OF ROSALTHA J. DAVIES
I, Rosaltha J. Davies of the City and County of San Francisco, state of California, of the age of eighty years, being of sound and disposing mind and memory and not acting under duress, fraud or undue influence of any person whomsoever do make and publish and declare this my last will and testament in manner following that is to say:
First..I direct that my executor, hereinafter named, pay my funeral expenses and all my just debts as soon as he has sufficient funds in his hands.
Second..I direct that my body be interred decently, with proper regard to my condition and station of life, and the circumstances of my estate.
Third..I hereby revoke all former wills by me made.
Fourth..I hereby give, devise and bequeath unto my beloved daughter Martha DeFrance the sum of Five Hundred Dollars ($500) provided that she survives me, in case she should not survive me, then in that event, the said sum of Five Hundred Dollars ($500) shall go to my beloved son, John A. Davies, this in addition to the bequest to said John A. Davies hereinafter set out.
Fifth..I hereby give devise and bequeath unto my beloved son John A. Davies the sum of Two Hundred Dollars ($200).
Sixth..To my daughter Elvira Davies, I hereby give, devise and bequeath the sum of Ten Dollars ($10)
Seventh..All the rest, residue and remainder of my estate, of whatsoever kind and nature, and wheresoever situated, I give, devise and bequeath until my beloved children, Jennie Davies McClymonds, Charles W. Davies and Mary Davies Smith, share and share alike.
Eighth..I hereby nominate and appoint L. T. Jacks, executor of this my last will and Testament, to serve with L. T. J. bonds, either upon sale of real property or otherwise.
It is my wish that should any of my estates located in the state of Iowa at the time of my death, or my executor L. T. Jacks deem it necessary to have an Executor appointed in the state of Iowa to carry out the terms of this will, that my friend William M. Lamb be appointed such executor to serve without bonds either upon sale of real property or other wise. It is my wish that Mr. William M. Lamb be consulted with reference to the business of said estate if it be found necessary.

The foregoing instrument consisting of one typewritten page besides this one, was at the date thereof by Rosaltha J. Davies the maker thereof in our presence and in the presence of eachof us, and at the time of her subscribing said instrument, she declared in our presence, and in the presence of each of us that it was her will and at her request, and in her presence, and in the presence of each other, we have subscribed our names at witnesses.
