MILLS COUNTY WILLS
Know All Men By These Presents: That I, Mary A. Evans of Malvern, Iowa, do make and
publish this my last will and testament, hereby revoking and cancelling any and all wills
heretofore executed by me.First - I nominate and appoint my daughters Ida L. Snyder, Anna F. Goodwin, Elizabeth J.
Lindsey and Edith M. Reed, executors of this will, and I direct that they be permitted to serve
as such executors without giving bonds, as I have full confidence in their integrity and
capacity.Second - I give and bequeath to my said executors named above, or such of them as shall
survive me and qualify as executors, all of the real estate of which I may be seized at the time
of my death, in trust however for the following uses and purposes. They shall as soon as
practicable after my death sell all of said real estate, and I give them power to exercise their
own discretion in making sales thereof, and to sell the same in separate tracts or parcels, and
to accept therefor such prices as in their judgement will represent the fair value thereof at the
time of the sale. I also empower them to execute and deliver to each purchaser thereof a
conveyance sufficient in law to vest in him the title and ownership of the property purchased
by him. I also give them power to extend to purchasers such terms as to times of payment as
in their judgment will be to the best interest of my estate, but require them to take ample
security for any portion of the price of the property, which is not paid at the time of the sale,
and they will have power to sell and assign any evidences of indebtedness received by them
in the sale of property.Third - They shall make the following disposition of the proceeds received from the sale of
said property. They shall pay all just debts which I may be owing at the time of my death, and
all costs and expenses incident to my last sickness and funeral. To Dorothy Evans, adopted
daughter of my deceased son, George D. Evans, the sum of One Hundred Dollars, which
amount I bequest to her, in lieu of, and in full satisfaction of any interest which the said George
D. Evans would have taken in my estate had he survived me. To each of my daughters, Ida L.
Snyder, Mary R. Swain, Anna F. Goodwin, Elizabeth J. Lindsey, Edith M. Reed and Ethel
Evans, the sum of One Thousand Dollars. The rest and residue of my estate after the charges
and bequests above provided for, shall be divided share and share alike, among my daughters
named above, and my sons Joseph G., William M., and Paul W. In the event that either of my
sons or daughters named above, other than Anna F. Goodwin, should not survive me, the
portion of the estate which would have gone to him or her under this will had he or she
survived me shall be paid to his or her legal heirs. Should Anna F. Goodwin not survive me the
portion which would have gone to her under this will shall be paid to her daughter Mary Ethel
Goodwin.Third - As I own no personal property except the furniture and other property in my home, my
executors need not inventory that or charge themselves with it, but the same may be divided
among my children in such manner as they may agree.Fourth - Should any of my children or said Dorothy Evans institute any contest of this will in
the Courts, such contestant shall by that act forfeit the whole of the bequest herein made to
him or her except the sum of One Dollar. In witness whereof I hereunto subscribe my name in presence of my subscribing sitnesses this
10th day of December, 1908.
