Samuel L. CREEK, Civil War veteran who was seriously injured yesterday afternoon about 1 o'clock when struck by a Rock Island freight train at Kirkwood Street, passed away yesterday afternoon at 4:15 o'clock at the Jefferson County Hospital where he was rushed after the accident.

Mr. CREEK was born Feb. 18, 1844, and just two weeks ago yesterday was the honored guest at a big birthday party given by the Daughters of Union Veterans. His wife, who was formerly Miss Harriet LAUGHLIN, died here about 10 years ago. They came to this city from Douds, Iowa, about 30 years ago, and since then he has resided here continuously.

His son, Edward CREEK, died at Eldon in 1917. Another son, who was known as "Doc", went west at the age of 19 years and has never been heard from since. He is survived by two daughters, Mrs. Alice DUKE of near Birmingham and Mrs. Anna LAUGHLIN of near Douds, and two sisters, Mrs. Maria BACON, Seattle, Wash., and Mrs. Everetta TAYLOR of Selah, Wash.

He also leaves the following grandchildren: Raleigh CREEK of Batavia; Raymond CREEK of Batavia; John CREEK of Libertyville; Van CREEK and Mrs. Robert FRESHWATER of Birmingham.

Mr. CREEK enlisted at Lincoln's call for troops, and was a member of Company F, Third Iowa Cavalry. He fought in Missouri being captured by the enemy in a battle at Florida, Mo., Mark Twain's birthplace. He narrowly escaped death when a guard "accidentally" discharged his gun at him, but lived to be paroled. He was in the force that captured Little Rock, and was in the attack on Semla, Ga., and many other engagements. When his first enlistment expired, he enlisted again and served until the end of the war.

Last rites will be held tomorrow afternoon at 2 o'clock from the Methodist Church in Libertyville in charge of Rev. I. R. Magers and interment will be in the Fell cemetery.
