Will Bk. B, p. 136. LAST WILL AND TESTAMENT OF SAMUEL SHIPLER, dec’d.
Filed June 3d, 1861;
admitted to probate and record July 1, 1861.“Des Moines Township, Jefferson County, Iowa, Friday May 24, 1861. Know all men by these presents that I, Samuel SHIPLER of the township, county and state above written, being of sound mind and memory, have made and do this 24th day of May, 1861, hereby make and execute this instrument of writing as my last will and testament, and to be the final direction and disposition of any earthly affairs, hereby revoking all former wills.
“I give bequeath and devise to my wife Mary Ann SHIPLER, and my son, Samuel H. SHIPLER, to be equally divided between them, all the money and property, of whatever description, which I now own…..or may hereafter acquire…..except all my real estate, and the household goods and furniture which belong to me. I also give bequeath and devise to my said wife and my said son Samuel H. SHIPLER, the present crop now in on my farm, to be equally divided between them at the maturity of the crops, or after harvesting the same. All the household goods and furniture belonging to me, I hereby give, bequeath and devise to my said wife.
“I direct and require my said wife and my said son, Samuel H. SHIPLER, to pay all my debts, and I hereby release Austin L. SHIPLER, my son, from all liability to my estate, arising out of my going his security. All the real estate which I now own, or may hereafter acquire, I wish disposed of according to law, but the interest and rights of my said wife, and my said son, Samuel H. SHIPLER, therein, are not to be impaired or dimished on account of the foregoing disposition of my personal property, neither is the legal division of the real estate to prejudice their ownership of the crop now coming forward on the farm……
