Grand Jury Fails To Indict In Shooting Fray.
Roush Released Following Hearing Here Wednesday.
Marvin Roush, 30 year old employee at the county shop, who admittedly shot Fulton McKinsey last Friday morning, after he found McKinsey visiting Mrs. Roush, was released from custody yesterday when the grand jury failed to return an indictment in the case.
McKinsey, meanwhile, is still a patient in a local hospital, with a .22 calibre bullet wound above the heart and another in the right arm. His condition was reported improving.
It was reported that Roush had previously warned McKinsey that trouble was imminent unless he discontinued his attentions toward Mrs. Roush, who had recently returned from California. Returning home unexpectedly Friday morning, Roush found McKinsey in his home and started shooting. He called the Sheriff's office and reported what had happened, apparently thinking he had fatally injured McKinsey.
Mrs. Roush, who was also held temporarily for investigation, was released and from all indications the case has been written off the books thus making way for an open season on errant husbands.
