WILL OF CHRISTIAN KAUFFMAN

I, Christian Kauffman, of Henry County, Iowa, being of sound mind and memory, hereby make and constitute this my last Will and Testament, hereby revoking all other Wills by me heretofore made.

1st. I desire that all my just debts and funeral expenses be paid as soon as practicable after my death.
2nd. I give, devise, and bequeath all the rest of my property, whether real or personal, to my wife, Elizabeth Kauffman, for her use, occupancy, and possession during the term of her natural life, under the restrictions hereinafter named. This bequest to be in lieu of dower.

3rd. I hereby appoint my son-in-law, James W. Bates, Executor of this Will, and in the settlement of my estate without bond, and I hereby authorize said Executor, with the consent of my said wife, to sell and convey any or all of the property of which I may die seized; without the previous order of the Court. And if the income from said property shall be insufficient for the proper support of my said wife, I authorize him in his discretion to use so much of the principal as may be necessary for that purpose. I also authorize him to expend so much as shall be necessary to provide for the wants of any of my children who may be in want as the result of affliction, not to exceed however, the share of such child, and such amounts as shall be thus expended shall be deducted from the share of such child, when the remainder of my estate shall be finally distributed. And in case my said Executor shall not act as such, and an Administrator shall be appointed by the Court, then such Administrator shall have like power as my said Executor, in all said matters, subject to the approval of the Court.

4th. Upon the death of my said wife, then my remaining property shall at once be divided equally among the heirs of my body as then existing. And in case of her remarriage, it is my Will that she shall have as her sole interest in my property the one/third of my remaining property, and the remaining two/thirds shall be the property of the heirs of my body, share and share alike.

Witness my hand this 15 day of September, 1905.

The undersigned, hereby subscribe our names to the foregoing instrument at the request of Christian Kauffman, and in his presence, and in the presence of each other. And the said Christian Kauffman signed said instrument in our presence, and declared the same to be his last Will and Testament.
