I, Horace Evans, considering the uncertainty of this mortal life and being of sound mind and memory, blessed be Almighty God for the same, do make and publish this, my last will and Testament in manner and form following, this is to say:

First, I give and bequeath to my beloved wife Eliza Jane the east undivided half of the farm, now possessing fifty-two acres and also half the timber land, twenty acres. Also the clock and the chest. And also one cow and all the bedclothes and the bedding and bedsteads she had when we were married. The remainder to my two daughters, Lawry M. and Candace Maria, the remainder of the bedding and equal between them and the chairs also. I give and bequeath to my eldest son, Osker, the west half of all the farm land, fifty-two acres and half of the timber land, twenty acres. He is to settle all my debts. Also the waggon (sic), oxen and plow if he accomplishes the contract we made. I give and bequeath to Rile D. one cow and two calves and his freedom to do for himself. I give and bequeath to my son Merritt F. one dollar and his time to be free and do for himself. Lawry M., Candace M., Biran and Isabell—they are all to draw an equal share of all the land that is willed to my wife Eliza Jane when the youngest comes to be of age over and above her thirds. And lastly, as to all the rest, residue and remaining of my personal estate, goods and chattels of what kind and nature soever, I give and bequeath the same to my said beloved wife Eliza Jane whom I hereby appoint sole executrix of this my last will and testament hereby revoking all former will by me made.

In witness whereof I have hereunto set my hand and seal the 25th day of July in the year of our Lord One thousand, eight hundred and sixty (1860).

Horace Evans (seal)

The above instrument of one sheet of paper was at the date thereof declared to us by the testator, Horace Evans, to be his last Will and Testament and he then acknowledged to each of us that he had subscribed the same and we at his request signed our names as attesting witnesses.
