SETH BURSON - FREMONT COUNTY
The last will and testament of Seth Burson of Fremont County, Iowa.
I, Seth Burson, considering the uncertainty of this mortal life and being of sound mind and memory do make and publish this my last will and testament in manner and form following (that is to say). I give and bequeath to my beloved wife, Anna Burson, my house and lot in Sidney described as follows: fifty feet of the East end of lot No. Nine and fifty feet of the East end of lot No. Ten in Block E. as described on the plat of the Town of Sidney. Also I give and bequeath to the said, Anna Burson, lot 7 and 8 in Block B. in Fremont City together with all the appurtanances belonging to both the above described premises. I further give and bequeath to the aforesaid, Anna Burson, two notes of hand, one on D. McF. Paul and Co. for one thousand dollars and one on Stone & Cole for four hundred dollars and I further give and bequeath to the said Anna Burson one note of hand on John Bollinger for twenty give dollars and one on Jesse Stafford for fifty dollars, one on Philip Moorman for seventy five dollars and ninety cents together with all other notes interests and accounts to me belonging and I further give to the said Anna Burson, my horse buggy cow household furniture bees implements of husbandry and everything else to me belonging of value to have and to hold for her exclusive use and benefit during her natural life.
And I give and bequeath to my children, that is to say to Joshua Burson, Henry Burson, Elizabeth Bollenger, Rebecca Nelson, Mahala Simons, Nancy Taylor, Jame Moorman, Milicent Cummins and (Asada?) Baldwin any property that may be left after the death of the aforesaid, Anna Burson, to be equally divided between them And I hereby constitute the aforesaid Anna Burson sole Executrix of this my last will and testament hereby revoking all former wills by me made.
In witness whereof I have hereunto set my hand and seal the 15 day of December in the year of our Lord, one thousand eight hundred and sixty six.....Signed Seth Burson (his X mark)
The above instrument consisting of two sheets was here subscribed by Seth Burson the testator in the presence of each of us and was at the same time declared by him to be his last will and testament and we by his request signed our names hereto as attesting witnesses...D. McF. Paul and Thomas M. Ewell
State of Iowa, Fremont County... I, Thomas M. Ewell, one of the subscribing witnesses to the within will of Seth Burson, late of said County, deceased, do solemnly swear that I saw said deceased make his mark to his signature of this will and believe he was of sound mind and memory and herein what he was doing when he made his mark to said signature.
