WILL OF HUGH IRWIN..filed 23 May 1889
Hugh Irwin of Fremont County, Iowa, being of sound mind and memory do make publish and declare my last will and testament to be in manner and form as follows, to wit:
1st I direct that all my just debts be fully paid as soon as can be done after my death without sacrifice to my estate.
2nd I give devise and bequeath to my wife Hannah Irwin one third in value of all my property both real and personal of which I may die the owner. Same to be to her in lieu of homestead and dower right.
3rd I give devise and bequeath to my son Darius Irwin, the following described Real Estate situated in Fremont County, Iowa, to wit: the South West quarter of the South West quarter of Section Twenty five (25) in Township Seventy (70) North of Range Forty two (42) West, and I further direct that in the event that my said son shall be deprived of said tract of land or any portion of same by (admeasurement?) of dower of wife or by any other means growing out of the settlement of my estate then he shall be paid by my executor out of my estate, the sum of twenty five dollars for each and every acre of said land of which he may be deprived.
4th In the event that anything remains after the full performance of the 1st, 2nd and 3rd clauses of this my will I direct that all of such remainder be equally divided (by) my sons and daughters to wit: Jas. H. Irwin, Levi Irwin, Solomon Irwin, Rebecca Longenecker, Robert Irwin, Ella Irwin and Walter Irwin.
5th I appoint my son Robert Irwin Executor of my estate. Witness my hand this 19th day of July 1887

DraperState of Iowa, Fremont County On this 19th day of July 1887 Hugh Irwin of Fremont County, Iowa, signed the foregoing instrument in the presence of each of us and at the same time and in the same presence declared the same to be his last will and testament and we now at his request and in his presence and in the presence of each other affix our names hereto this day and date heretofore mentioned as witnesses of such signature and execution. State of Iowa, Fremont County, J.P.Glower clerk of the courts in and for said county and state certify that the foregoing will of Hugh Irwin was on the 18th day of Sept 1889 duly admintted to probate by the court. Witness my hand this 30th day of Dec. 1889.
