LAST WILL AND TESTAMENT OF PHILIP NIES, DECEASED
(not my family)

I, Philip Nies of Fremont County Iowa being of sound and disposing mind and memory do make
publish and declare this my last will and testament hereby revoking all former by me heretofore
made. It is my will and desire that at my death all and singular of my interest in real estate that I
may die seized of shall be sold as my executors hereinafter named shall think best and to the best
advantage and the proceeds thereof shall be applied to the payment of my debts if any remaining of
the payment of my debts and funeral expenses the same shall be paid over to my wife for her sole
use and benefit and for the purpose of carrying out this my last will and testament I hereby appoint
as my executors Peter Nies and Henry Nies and that they shall act as my executors in the sale and
settlement of my said estate without bond.

In witness whereof I have hereunto set my hand to this my last will and testament this the 6th day
of August 1880.....Signed Philip Nies

Signed sealed and declared by the above named Philip Nies as and for his last will and testament
in the presence of us who at his request and in his presence have subscribed our names as
witnesses thereunto this the 6th day of August 1880

State of Iowa, Fremont County
I, W. G. Templeton Clerk of the Circuit Court of the County and State aforesaid do hereby certify
that at the May term 1881 of said court on the 25th day of May 1881 the foregoing will of Philip Nies
deceased, as duly proven allowed and admitted to probate.
In testimony whereof I have hereunto set my hand and caused the seal of said court to be affixed at
my office in Sidney this 25th day of May 1881....W. G. Templeton, Clerk of Circuit Court.
