I, Lyman P Bates, of the County of Davis and state of Iowa, weak in body, but sound in mind and 75 years of age, I am admonished that it is prudent to so dispose of my property that my heirs may have no trouble in understanding my wishes as to its distribution at my decease.
To Leslie H Bates, my son, I give and bequeath that tract of land known as the North part of the West half of the Southeast QR of section 26 township 69 Range 14 West; consisting of 59 acres, with all the appurtenances and all the household goods, books, and specimens now in the house; also to the said Leslie H Bates, my son, all the land that I now own in Section 32 township 69 range 14 West, said land lies South of the public highway and includes the residence on such land, as is now known as my land; also said Leslie H Bates is to have the books and specimens and furniture in said house; also the said Leslie H Bates, my son, is to have the West 80 acres of the SE Qr of section 28, township 69 North, Range 15; these several tracts named contains 350 acres, all of which shall belong to said Leslie H Bates at my decease.
2nd, I give to my daughter Mrs Leilla O Glenn no land, as I fear she would waste the proceeds, mortgage any land I might give her and spend the money without being benefited either herself of family; but instead I give and bequeath to my daughter’s 2 children Pearl & Robert Glenn jointly certain rents to be theirs until said Robert shall arrive at the age of 21 years, then to be theirs in free simple. Said land is described as follows, a certain tract consisting of the 115 acres lying on the North side of the public highway and being the east part of section 30, township 69 Randge 14 west, being one half [less than 5 acres] of my land north of said highway and in above description, the west line would be several rods east of the old orchard, and for precise location I refer to Milton R Harris and Leslie H Bates; I also bequeath to my daughter Leilla O Glenn, 25 dollars in money to be paid to her at my death out of any money or credits I may possess.
3rd, To my daughter, Leah E Harris, wife of Milton R Harris, I bequeath in trust so long as she may live, and at her death to belong to her children in fee simple. The tract of land west and adjoining the last described land being in section 30, town 69, Range 14 west. Also the said Leah E Harris the east 80 acres of the SE ¼ of section 28 tp. 69 R 15 west in trust so long as she may live, and then to belong to her children in fee simple forever:
To my grandson, Sidney W Bates, son of Lewis W Bates, my son, 60 acres and as I cannot define the same will say, the tract, lies north of and adjoins Phillip Thornburg land bought of me, and in section 28 tp 69 R 15 West; being north west part of my land in above section, to belong to said Sidney W Bates on his arriving at the age of 21 years.
Also one qr. Section known as the north west qr. Of section 20 Tp. 69 R 15 west to be divided between my grand children being the children of my deceased daughter, Mrs Louisa T Callen, former wife of D C Callen. This quarter section to be divided as follows, The south East 40 acres to my grandson, Herbert R Callon, with the house. Then the next oldest the 40 acres west. To the next oldest the remaining 40 acres. These bequest not to include Miss Mabel Callen, who is to be remembered by a sum of money viz 150 dollars.
Also another grandchild of the Callen family is to have a like sum of one hundred and fifty dollars. The youngest child on arriving at the age of 18 years. These money requests can be paid out of any monies or credits now in my possession, or if not sufficient, the rents of said lands for 1827 can make up the balance, and any rents not needed for expenses or bequests, may remain with and be owned by Milton R Harris and Leslie H Bates.
At this date besides the above described lands, I have notes as follows; $300, 5 years from date at 3% int.; $200 due Jan 1st 18997 Cr. $5.00; $30 due Jan 1st 1897 Cr. $5.00; $37.00 Sept 1, 1896
$50.00 bank derf. Dep. The above notes could probably be converted into money to pay above bequests.

A Petition to Construe this will is dated October 1902. As the land in said will has changed description. Also, Leilla O Glenn, has deceased.
