Will of Benjamin Baker
The following is the record of the last Will and Testament of Benjamin Baker, Deceased.
I, Benjamin Baker of Lyons Township County of Clinton and State of Iowa being of sound mind do hereby publish and declare this to be my last Will and Testament.
Firstly, I give and bequeath to my beloved wife Lydia the following described premises situated in the County of Clinton and the State of Iowa, DeWitt. Eighteen acres of timberland to be taken off of the South side of the North xxxx fractional Quarter of the North East Quarter of Section No. Eight (8) in Township No. Eighty two (82) North of Range Seven East during her life and after her decease then to my son Daniel W. Baker and his heirs forever and also one half of the xxxxxx profit of the South East fourth of the South West Quarter of Section No. Twenty-four (24) in Township No. Eight-two (82) North of Range six (6) East also one half of the xxxxx and property of the North West fourth (1/4/) of the North East Quarter of Section No. Twenty-five (25) in Township no. Eighty-two North of Range Six (6) East excepting a certain reservation for a road along the South side of the land that this bequeath being made in him of XXXX .
Secondly, I give and bequeath unto my son David W. Baker the following described properties situated in the County of Clinton and State of Iowa De Witt; the South East fourth of the South West Quarter of Section No. Twenty-four (24) in Township No. Eight two (82) North of Range Six (6) East and also the North West fourth (1/4) of the North East Quarter of Section No. Twenty-five(25) in Township No. Eighty-two (82) North of Range Six East Reserving to the use of my wife Lydia Baker one half of all the rents and profits of the said Estate to be paid to her annually in lieu of her right of xxxxx for her natural life and reserving a section one xxxxwide on the South side of the premises hereinxxx described given to George P. Baker.
I also give and bequeath to xxxxx David M. Baker ten acres of timberland to be taken off of the East End of the South half of the South East fourth of the North West XXXXX of Section No Eight (8) in Township No. Eighty-two (82) North of Range Seven (7) East.
Thirdly, I give and bequeath unto my son George P. Baker the following described premises situated in the County of Clinton and State of Iowa, DeWitt a strip of land one XXXX wide along the South xxxx of the North west fourth (1/4) of the North East Quarter of Section No. twenty five (25) in Township No. Eighty two (82) North of Range Six (6) East for the use of a road or xxxxxx on the condition that xxxx shall keeping in xxxxx repair a xxx and substantial xxxx between the xxxx road and my premises herein bequeathed to Daniel W. Baker and I also give and bequeath to my son George P. Baker five acres of timberland to be taken off the West end of the South half (1/2) of the South East fourth (1/4) of the North West Quarter of Section No. Eight (8) in Township eighty two (82) North of Range Seven (7) East.
Fourthly, I give and bequeath to my son Chester P. Baker the following described premises situated in the County of Clinton and State of Iowa, DeWitt. Eighteen and one half acres of timberland off the South side of the No. Three (3) in the North East Quarter Section No. eight (8) in Township No. Eighty Two (82) North of Range Seven East.
Fifthly, I give and bequeath unto my daughter, Clarissa M. Thomas the following described premises situated in the County of Clinton and State of Iowa DeWitt. Seven and one fourth acres off the North side of the North West fourth of the North West Quarter of Section No. twenty five (25) in Township No. Eight (82) North of Range Six (6) East.
Sixthly, I give and bequeath unto my sons Chester P. and David M. a set of Blacksmith(?) tools.
I hereby appoint Roswell B. Millard my lawful Executor to carry out the design (?) and will of this my last will and testament.
In Testimony whereof, I set my hand and seal this 13th day of September A.D. 1855.
