Last Will and Testament of Thomas Large

The last will and testament of Thomas Large of DeWitt Iowa.
I Thomas Large of the township of DeWitt County of Clinton and State of Iowa being of sound mind and memory do make declare and publish this my last will and testament and I hereby revoke all prior wills by me heretofore made.

First: I direct my executors hereinafter named to pay all my just debts including the cost of administration.

Second: I give devise and bequeath to my beloved wife Mary Large one half of all my household and kitchen furniture and also one half of any heirlooms, also all the property that the law exempts from execution to have and to hold as her own and in her own right forever. I also bequeath to her the South east quarter of the North east quarter of Section number thirty-one (31) and the South half of the North west quarter of Section number thirty-two (32) all in Township eighty two (82) North Range four (4) East 5 P. M. Also the west one fourth of the North east quarter of the North west quarter of Section number twenty-four (24) Township Eighty-one (81) North range (3) East of the 5 P. M. she to have the full and absolute control over the same for and during her natural life to enjoy the rents and profits of the same and upon her death the same is to be divided equally between my children by my said wife Mary to wit:
Thomas Large, Mary Francis Large, Robert Henry Large, Joseph Large, share and share alike and she is to accept the above in lieu of dower and homestead rights in all of my property.

Third: I give and bequeath to my son William Large the east half of the North east quarter also the North half of the South East quarter and the South East quarter of the South West quarter all in Section thirty two (32) Township Eighty two (82) North Range four (4) East 5 P. M. and he is to pay his sister my daughter out of said land the sum of one thousand five hundred dollars to Deborah Large on or before five years from the day of my death with interest on said fifteen hundred dollars at the rate of 8% per annum payable annually from and after the day of my death and he is also to pay his sister, my daughter Julie Torgensen on or before five years from and after the day of my death one thousand dollars with interest on said one thousand dollars at the rate of 8 % per annum payable annually from and after the day of my death and the moneys are to be a lien upon said land until they are paid. I also bequeath to my son William my one third interest in the west half of the North east quarter of section thirty two (32) in Township eighty-two (82) North range four (4) east 5 P.M. and my wish is that he takes said one third out of said land so as to include the house in which I live at present including barn and yards. I also give and devise to him my gold watch and chain, all of the above property to him and to his heirs forever.

Fourth: I give and bequeath to my son William Large and to my daughters Julie Torgenson and Deborah Large the one half of my household and kitchen furniture and heirlooms share and share alike and I further direct that said household kitchen furniture and heirlooms are to be divided by John Alexander Smith one of my executors hereinafter named between my wife and my children as directed by my will.

Fifth: On the event of the death of either of my said children William Large, Julia Thorgensen or Deborah Large without issue or before my decease then it is my wish that the share that would gone to the child or children that are dead shall go to the survivor or survivors of said William, Julia or Deborah.

Sixth: On the event of the death of either of my said children before they attain their majority (Thomas Large, Mary Francis Large, Robert Henry Large or Joseph Large) then and on that event it is my will that the survivor or survivors shall take the share of those who are dead.

Seventh: On the event of my Daughter Deborah Large should make any claim for wages or any other compensation from my estate any anything should be allowed her the amount so allowed her to be deducted from the $1500 left her in this my will and the same is to be paid to the extent of $1500 to her by my son William Large and the amount he so pays to be deducted out of the $1500 he is to pay her as directed in the third paragraph of this my will.

Eighth: I direct my executors hereinafter named as soon after my death as is practicable to sell all of my personal property not otherwise disposed of in this will and after paying all my debts to divide the remainder equally between my children. William Large, Mary Francis Large, Robert Henry Large and Joseph share and share alike.

Ninth: Having already given to my son James Large his full share of my property in the way of advancement it is my will that he shall receive no part of portion of my estate.

Tenth: I nominate and appoint as guardian of the property of my minor children Thomas Large, Mary Francis Large, Robert Henry Large, and Joseph Large, their mother Mary Large and I exempt her from giving any bond or security for her doings as guardian.

Eleventh: I nominate and appoint as executors of this will my son William Large and my friend John Alexander Smith. Witness my hand this 28 day of October 1882.

The a foregoing instrument was signed by Thomas Large in our presence and we at his request and in his presence and in the presence of each other have subscribed our names hereto as witnesses the day and year above written.

Codicil to Will of Thomas Large of date October 28 1882.
I Thomas Large of sound mind and memory do make declare and publish this codicil to my will of above date.
I modify the second paragraph of my will in this I give devise and bequeath to my beloved wife Mary Large all of my household and kitchen furniture.
Having purchased and now owning the north half of the North west quarter and the North west quarter of the South west quarter of Section thirty-two (32) in Township Eighty two (82) North Range four (4) East 5 P. M. The above land I devise to my wife Mary on the same terms and conditions as in the second paragraph of my will and on her death to go to the same parties to whom I have devised the land in the second paragraph of my will. I hereby revoke the fourth paragraph of my will having in the above given all of my household and kitchen furniture to my wife. I modify the third paragraph of my will in this I revoke the clause giving to my daughter Deborah Large fifteen hundred dollars and in lieu of thereof I bequeath to her one thousand dollars subject to the same terms and conditions as contained in said third paragraph. I having purchased and now owning the North East quarter of the South West quarter of Section thirty-two (32) in Township Eighty two (82) North range four (4) east 5 P. M. I give bequeath and devise the above property to my son William Large and to his heirs forever but out of the same he is to pay to his sister Mary Francis Large the sum of one thousand dollars on or before five years from and after my death with interest on said one thousand dollars at 8% per annum payable annually.

I William Kreim, clerk of the District Court in and for said County do hereby certify that on this day at the January Term A. D. 1889 of said Court the will and instrument in writing hereunto annexed and bearing date in the 28th day of Oct.1882 and Oct. 23, 1887 was duly proved before and allowed by said court as and for the last will and testament of the real and personal estate of Thomas Large late of said County deceased and was by said Court ordered to be recorded as such will and testament. In witness whereof I have hereunto at my hand and affixed the seal of the court at my office in Clinton in said County this 15th day of January A. D. 1889.
