Last Will and Testament of Claus Peterson

Know all men by this presents that I Claus Peterson of Elk River Township in the County of Clinton and State of Iowa Farmer being of sound mind and memory to make and publish this my last will and testament.

First: I give and bequeath to my wife’s brother Johan Graves One Thousand ($1000) dollars on the 1st. day of January 1891 or when he shall have attained 23 years of age.

Second: I give and bequeath unto my beloved wife Mary Peterson all my household goods, furniture, wearing apparel and all the rest and residue of any personal property after paying the above legacy of (1000) dollars: but if there should not at my decease be sufficient personal property to pay the 1000 dollars legacy then so much of my real estate shall be sold as will raise sufficient money to pay the same.

Third: I give and devise to my beloved wife Mary Peterson all the rest and residue of my real estate viz: The S. E. of S. E. and N. E. of S.W. of N.W. of S. E. of Sec. 9 and S. E. of S. E. of Sec. 10 all in T. 83 N. R. 6 E of 5 P. M.

Fifth: I ordain and appoint as my executor of this my last will and testament. (no one stated)
In testimony whereof I have here unto set my hand and seal and publish and declare this my last will and testament in the presence the witnesses named below this 29th day of June 1888.

Signed sealed publish and declared by said Claus Petersen as and for his last will and testament in presence of us who in his presence and in presence of each other and at his request have hereunto subscribed our names as witnesses.

I William Kreim, clerk of the District Court in and for said County do hereby certify that on this day at the January Term A. D. 1889 of said Court the will and instrument in writing hereunto annexed and bearing date in the 28th day of June 1888 was duly proved before and allowed by said court as and for the last will and testament of the real and personal estate of Claus Petersen late of said County deceased and was by said Court ordered to be recorded as such will and testament. In witness whereof I have hereunto at my hand and affixed the seal of the court at my office in Clinton in said County this 7th day of February A. D. 1889.
